HomeMy WebLinkAboutOrdinance 16577-09-2005ORDINANCE NO /1~S71-e9 ~o~ AN ORDINANCE ADOPTING THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS) AS THE STANDARD FOR INCIDENT MANAGEMENT BY THE CITY OF FORT WORTH, TEXAS WHEREAS, on February 28 2003 the President issued Homeland Security Presidential Directive (HSPD) - 5 that directed the Department of Homeland Security in cooperation with representatives of federal, state, and local government, to develop a National Incident Management System (NIMS) to provide a consistent approach to the effective management of situations involving natural disasters, man-made disasters or terrorism, and WHEREAS the final NIMS was released on March 1 2004 and WHEREAS, the NIMS contains a practice model for the accomplishment of the significant responsibilities associated with prevention, preparedness, response, recovery and mitigation of all mayor and national hazards situations, and WHEREAS the HSPD-5 requires that state and local governments adopt the NIMS by fiscal year 2005 as apre-condition to the receipt of federal grants, contract and activities related to the management and preparedness for certain disaster and hazard situations, and WHEREAS the City Council for the City of Fort Worth, Texas desires to adopt the NIMS as required by HSPD-5 WHEREAS, the City Council of the City of Fort Worth, Texas, finds that it has a governmental interest in protecting the general welfare, health, safety and order of the citizens of Fort Worth, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS Section 1 That the City of Fort Worth hereby adopts the National Incident Management System dated March 1 2004 as shown on the attached Exhibit A. Section 2. This ordinance shall be cumulative of all provisions of the Code of the City of Fort Worth (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of this ordinance and such Code, in which event conflicting provisions of such ordinances and such code are hereby repealed. Section 3. This ordinance shall take effect upon adoption. City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 9/13/2005 Ordinance No 16577-09-2005 DATE Tuesday September 13 2005 LOG NAME. 36NIMS REFERENCE NO *G-14917 SUBJECT Adopt Ordinance Adopting the National Incident Management System (NIMS) as the Standard for Incident Management by the City of Fort Worth Texas RECOMMENDATION It is recommended that the City Council adopt the attached Ordinance adopting the National Incident Management System (NIMS) as the standard to utilize for Incident Management and Emergency Prevention preparedness, response, recovery and mitigation activities. DISCUSSION In Homeland Security Presidential Directive-5 (HSPD-5) President Bush called on the Secretary of Homeland Security to develop a National Incident Management System (NIMS) to provide a consistent nationwide approach for federal state tribal and local governments to work together to prepare for prevent, respond to and recover from domestic incidents, regardless of cause, size or complexity On March 1 2004 after close collaboration with state and local government officials and representatives from a wide range of public safety organizations, Homeland Security issued the NIMS It incorporates many existing best practices into a comprehensive national approach to domestic incident management, applicable at all jurisdictional levels and across all functional disciplines Governor Perry issued Executive Order RP 40 on February 23 2005 adopting the NIMS as the statewide system to be used for emergency prevention preparedness, response recovery and mitigation activities, as well as in support of all actions taken to assist local entities. Implementation of and compliance with the NIMS is critical to ensuring full and robust preparedness across our state FY2005 is a start up year for NIMS implementation and full compliance with the NIMS is not required to receive FY 2005 grant funds. However in order to receive FY 2006 preparedness grant funding the minimum FY 2005 compliance requirements must be met. The compliance requirement is for the governing body to adopt aCity/County Ordinance adopting NIMS Applicants will be required to certify as part of their FY 2006 grant applications that they have met the FY 2005 NIMS compliance requirements. Adopting the NIMS (available for review in the City Secretary's Office) will enable the City of Fort Worth to receive grant funds and utilize the NIMS to provide a consistent approach to the effective management of situations involving natural disasters man-made disasters or terrorism FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that certifies this action will have no material effect on City funds.
