ORDINANCE NO. ORDI'NANC'E ACCEPTING DWROVIDIENTS ON A PORTION OF Panola Ave. AND PORTIONS OF SUNDRY OTHER STREETS, AV11IMS AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; ILCIARING THE CO2'TRACT WITH €flCIAL RIC010 Worth Construction Co. FOR THE CONSTRUCTION OF SAID 11p IMPROP'1•LNTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUAIJ TY SECRETARY ESECULION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL AS �3- MENTS LEVIEM AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHOR , WORTH, AND ALLOWED AGAIN*ST SOME OF SAID ASSESSM'0TS; DIRti.'CTING THE CITY SECRETARY TO ENGROSS AND E?IROLL THIS OFDI"ANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINAA*CE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AMD EFFVTIVE DATE. IfTMEAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Worth Construction Co. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. Panola Street: From Oakland Blvd. to Rand Street, known and designated as Unit No. 3. 2. Panola Street: From East Line of Hughes to Tierney Road, known and designated as Unit No. 4. WEMW, by sundry proceedings heretofore passed by the City Council of the City of Port Worth, Texas, including Ordinance No. 4607 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Port Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4607 , and W=AS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TH=FORE, BE IT ORDAI_::D BY THE CITY COUNCIL OF Tie CITY OF FORT WORTH, Tv,XAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates snail be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, toether with the names of the owners of said property, the principal amotrat of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: 12t. When each of the certificates has been duly executed as hereinabove provid- ed. same shrill be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. It was necessary to have the contractor move to and from the project several times to coordinate with utility construction, conflicting with his work schedule on other projects. Pro 1 ect Cost and Financing Bid Price: $32,071.00 (Units III and IV) Final Contract Cost: #35,771.30 (Units III and IV) Partial Payments Previously Made: 7 Amount: $31,519.35 Final Payment Due: $4,251.95 (Units III and IV) Payment to be made from Account No. 94-B7-3 Deviation from bid price due to following items: 1) Additional excavation to lower sub-grade + $3082 2) Additional gravel sub-grade material + 11,671 3) Variations between estimated and measured quantities - 1.353 Total $3,700 Compliance With Specifications,. Attached is a tabulation of paving test cores showing compliance with specifications. Prior to stabilization of the gravel base with cement, soil constants including plasticity index, and gradation tests were made and shcwed that the material used was in compliance with specifications. �.
