ORDINANCE N0, �S3 n ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF Maddox A miw AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH FOR THE CONSTRUCTION CF SAID IMPROVEMENTS Y FU COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAIM T SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with R.W. Gibbins. Inc. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. Maddox Avenue From Riverside Drive to Mitchell Boulevard known and designated as Unit No. 1, Project No. 094-22000-117 WHEREAS,-by sundry proceedings heretofore passed by the Cita Council of the City of Fort Worth, Texas, including Ordinance No. 5360 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5360 , and WHEHEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and perfomed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the differenceibetween the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax. Assessor-Collector as past payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Msnute Book of the City Council of Fort ;,forth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the d9te of its passage. W. Gibbins, Inc. Contract Awarded: April 5, 1965 (M&C C-479) Work Order Issued: July 12, 1965 Work Order Effective: July 26, 1965 Date of Final Inspection and Approval: December 30, 1965 Working Time Bid: 75 Working Days Working Time Used: 95 Working Days Adjusted Working Time Charged: 81 Working Days Because of extra work required to install subgrade drains and provide side street drainage not included in original project plans, the Public Works Department recommends that the working be extended 14 days. The six remaining days overtime are charged at the rate of $75 per day liquidated damages in accordance with standard contract provisions for projects ranging in price from $50,000 to $100,000. Project Cost and Financing Bid Price: $74,872.95 Project Cost: $82,264.74 Less 6 Days Liquidated Damages at $75 per day - 450.00 Final Construction Cost: $81,814.74 Partial Payments Previously Made: 7 Amount: $73,287.67 Final Payment Due: $8,527.07 Deviation from Project Cost and Bid Price: $7,391.79 over-run because of the following reasons: 1) During excavation on Maddox Avenue, seepage was encountered which would have been detrimental to the subgrade. In order to correct this condition, it was necessary to construct 6-inch subdrains. + $1,914.00 2) Due to side street drainage, it was necessary to construct 183 feet of storm drain pipe and three standard 10 foot inlets that were not originally anticipated. + 2,824.90 3) Variations between quantities estimated in the contract specifications and quantities measured and used at the job site. + 2,652.89 Total Over-run OFFICIAL RECORD $7,391.79 CITY SECRETARY FT. 4i�u , 3 m DATE REFERENCE SUBJECT: Final Payment, Maddox Avenue PAGE NUMBER Widening & Improvements, Riverside Drive 2 2 2/28166 FP-316 to Mitchell Pro ' . 094-22000-117 of Compliance with Specifications During testing on this project, 33 corings were made with the following results: Exceeds Even With Under Specs But Below Paving Specs Specs Within Tolerance Tolerance Surface 20 2 5 6 Base 26 7 0 0 The six cores indicating below tolerance surface thickness were in two areas which were subsequently overlaid with an additional one-inch of hot-mix asphaltic concrete. Prior to corrective action, the surface cores showed an average thickness of 7.38 inches, compared with 7.5 inches specified. The base cores averaged 4.39 inches compared with 4.0 inches specified. Recommendation It is recommended that the project be accepted by adoption of an ordinance and that final payment of $8,527.07 be authorized to R. W. Gibbins, Inc. JLB:1p Attach.
