HomeMy WebLinkAboutOrdinance 6030 ORDINANCE NO. AN ORDINANCE PROVIDING THAT A PORTION OF THE RIGHT OF WAY OF THE NORTH SERVICE ROAD OF U. S. HIGHWAY 80 IN THE HAYS COVINGTON SURVEY, AB- STRACT NO. 256, IN FORT WORTH, TARRANT COUNTY, TEXAS, BE VACATED, ABANDONED AND CLOSED; PROVID- ING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described portion of the right of way of the north service road of U. S. Highway 80 in the Hays Covington Survey, Abstract No. 256, in the City of Fort Worth, Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and ex- cept that easements are reserved for any and all existing and future utilities: Beginning at the southeast corner of Lot 1 in Tract B of Block 2, Western Hills Addition, Section One, according to a deed recorded in Vol. 3976, at page 50, of the Deed Records of Tarrant County, Texas; Thence south 7 degrees 42 minutes west 45.0 feet to an iron pin for a corner; Thence north 82 degrees 18 minutes west 97.0 feet to an iron pin for a corner; Thence north 7 degrees 42 minutes east 45.0 feet to an iron pin for a corner, said corner being also the southwest corner of said Lot 1 in Tract B, Block 2, Western Hills Addition, Section One; Thence south 82 degrees 18 minutes east 97.0 feet to the point of beginning, and con- taining 0.01 acre of land more or less. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said right of way is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Smith, owner of Lot 1, Block 2, Western Hills Addition, has R requested the City to vacate 45 feet of the surplus portion of,the DY !i RFrontage Road right-of-way, U. S. Highway 80, which adjoins his property. This request is made to permit the right-of-way to be incorporated into the lot owned by Dr. Smith. The area requested to be vacated"is the north 45 feet of the right-of-way of the north service road of U. S. Highway 80 in the Hays Covington Survey, Abstract No. 256, Fort Worth, Tarrant County, Texas. This portion of the Frontage Road right-of-way is not open or paved and guttered. The existing 282 feet of right-of-way is much greater than is needed since the opening of I-20; therefore, the subject right-of-way is excess and the remaining 192 feet is all that will be required in the future. The City departments and private utility companies have reviewed this request. They have no objection to this vacation provided the applicant plats the vacated right-of-way with the adjoining property and retains the vacated right-of-way as an easement for existing and future utilities. The City Plan Commission has reviewed the proposed vacation and recommends adoption of an ordinance vacating the right-of-way, subject to the appli- cant's platting the vacated right-of-way with the adjoining property and retaining the vacated right-of-way as an easement. A plat which includes the vacated right-of-way and which also provides the necessary easements has been filed with the Planning Department. Recommendation It is recommended that an ordinance be adopted closing the subject right- of-way as recommended by the City Plan Commission.
