HomeMy WebLinkAboutOrdinance 6730 ORDINANCE NO. r07,30 AN ORDINANCE AMENDING CHAPTER 16 OF EXHIBIT "B" OF THE ELECTRICAL CODE OF THE CITY OF FORT WORTH, SAID ORDINANCE CONCERNING CERTAIN EXCEPTIONS TO THE PRE- SCRIBED METHODS OF WIRING; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES AND PROVISIONS OF THE ELECTRICAL CODE OF THE CITY OF FORT WORTH; REPEALING ALL ORDINANCES OR PROVISIONS OF THE ELECTRICAL CODE OF THE CITY OF FORT WORTH IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Special Exception (2) of Section 1601 of Chapter 16, "General Wiring Methods and Materials" of Exhibit "B, " attached to and incorporated by reference in the Electrical Code of the City of Fort Worth, be and the same is hereby amended and, after being so amended, shall hereafter read as follows: " (2) The provisions of this section shall not apply to Group H apartment houses, Group I Occupan- cies and Group J Occupancies, three stories or less in height, as same are defined in the Fort Worth Building Code. The provisions of this section shall apply to the separate branch service conductors to individual apartment breaker panels, to occupancies other than Group H apartment houses, Group I Occu- pancies and Group J Occupancies located in the same building, and to occupancies where two or more wash- ing machines or drying machines are located, and to mechanical buildings and other nonresidential occu- pancies." SECTION 2. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections hereof, since the same would have been en- acted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3. That this ordinance shall be and is hereby declared to be cumulative of the provisions of the Electrical Code of the City of Fort Worth and amendments thereto, regulating and controlling the installation and alteration of electrical equipment, except in those instances where the provisions of this ordinance are in direct conflict with such Code, in which instances said conflict- ing provisions of such Code are hereby repealed. SECTION 4. That all pending litigations and existing violations, both civil and criminal, whether pending in court or not, under the Electrical Code of the City of Fort Worth and amendments thereto superseded by this ordinance shall not be affected by this ordi- nance but may be prosecuted until final disposition by the courts. SECTION 5. That any person, firm, association of persons, company or corporation or their agents, servants or employees who violate, disobey, omit, neglect or refuse to comply with any provision of this ordinance shall be punished by a fine of not to exceed two hundred dollars ($200.00) , and each day that a violation exists is hereby declared to be a distinct and separate offense and punishable as such, all as provided for in Section 1-5 of Chapter I of the Code of the City of Fort Worth (1964) , as amended. -Mk SECTION 6. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law, and it is so ordained. The Department of Housing and Urban Development, in conjunction with its review of the City's application for Workable Program certification, has advised that this provision must be restricted to apartment structures of three stories or less. It is therefore proposed that the Code be amended to this effect. Recommendation It is recommended that an ordinance be adopted revising the Electrical Code to limit the use of nonmetallic-sheathed cable in Group H construction to apartment structures of three stories or less.
