AN ORDINANCE AMENDING SUBSECTION (C) (1) (e) OF
SECTION 43-1 CHAPTER 43 - CODE OF ETHICS,
(ORDINANCE NO. 7582 ADOPTED JULY 26, 1977, AS
AMENDED) OF THE CODE OF THE CITY OF FORT WORTH,
TEXAS (1964) , AS AMENDED, BY EXCEPTING FROM
PROSCRIBED TRANSACTIONS BETWEEN THE CITY AND
OFFICERS THEREOF, THOSE TRANSACTIONS BETWEEN
THE CITY AND MEMBERS OF PURELY ADVISORY BOARDS
AND COMMISSIONS HAVING NO COGNIZANCE OVER SUCH
TRANSACTIONS; MAKING THIS ORDINANCE CUMULATIVE
OF OTHER ORDINANCES AND PROVISIONS OF THE CITY
CODE AND REPEALING ALL ORDINANCES OR PROVISIONS
OF THE CITY CODE IN CONFLICT HEREWITH; PROVIDING
A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Subsection (C) (1) (e) of Section 43-1, Code of Ethics
Adopted, of Chapter 43- Code of Ethics, of the Code of the City of
Fort Worth, Texas (1964) as amended, which said subsection proscribes
certain knowing business activities with the City by officers and
employees of the City or their spouses, is hereby amended to add an
exception numbered 4 to said proscription authorizing business
activities between the City and appointive members of purely advisory
boards, commissions or committees so long as the board, commission or
committee on which they serve has no advisory function or cognizance,
direct or indirect, present or prospective, with respect to the trans-
action in which such member engages or proposes to engage; and after
being so amended, said Subsection (C) (1) (e) of Section 43-1 of
Chapter 43 of the Code of the City of Fort Worth, Texas (1964) , as
amended, shall have a fourth exception thereunder which shall be
and read as follows:
" (C) Standards of Conduct.
" (1) No officer or employee of the City,
or their spouses, shall knowingly:
" (e) Engage in any exchange, purchase,
or sale of property, goods, or services
with the City, or enter into any contract
with the City, except:
"4. Appointive members of purely advisory City
boards, commissions or committees set up
by ordinance, charter or state law who are
not otherwise officers or employees of the
City, may engage in any exchange, purchase
or sale of property, goods or services with
the City, or enter into a contract with the
City provided, however, that the board,
commission or committee of which they are a
member has no advisory function or cognizance,
direct or indirect, present or prospective,
with respect to the transaction in which such
member engages or proposes to engage."
SECTION 2.
That this ordinance shall be cumulative of all pro-
visions of the Code of the City of Fort Worth (1964) , as amended,
and all other ordinances of the City of Fort Worth, except in those
instances where the provisions of this ordinance are in direct
conflict with the provisions of such Code or other ordinances, in
which instances said conflicting provisions of such Code or other
ordinances are hereby repealed.
SECTION 3.
That it is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
void, ineffective or unconstitutional by the valid judgment or final
decree of any court of competent jurisdiction, such voidness, ineffec-
tiveness or unconstitutionality shall not affect any remaining
phrases, clauses, sentences, paragraphs and sections of this ordinance,
since the same would have been enacted by the City Council without the
incorporation herein of any such void, ineffective or unconstitutional
phrase, clause, sentence, paragraph or section.

SECTION 4.
That this ordinance shall become effective and be in full
force and effect from and after the date of its passage and
publication as required by law, and it is so ordained.
