setting aside a portion of the tax levy for the Park Department of the
City of Fort Worth, for the years 1922, 1923 and 1924 to pay for improve-
ments of streets abutting on Circle Park.
BE IT ORDAINED BY THE BOARD OF CO&MBSIONERS, of the City of Fort Worth,
Texas, THAT, irhereas, on the 28th day of September 1920, the Board of
Commissioners of the City of Fort Worth directed the improvement of Lin-
coln Avenue between Central Avenue and Circle Park Avenue by paving etc., and
WHEREAS, on the 12th day of March 1921, the said City of Fort Worth did en-
ter into a contract with the Texas Bitulithic Company for the construction
of said improvement and pe.ving on said streets, and WHEREAS, on the 27th
day of December 1921, the said City through its Board of Commissioners did
levy an assessment against the Fort Worth Park Department for paving said
streets in front of Circle Park, fronting (200) feet on said Lincoln Avenue
amounting to #1386.44, and interest not to exceed eight per cent from date
of completion and acceptance of said improvement, and
WHEREAS, the Board of Park Commissioners has requested the Board of Commis-
sioners of the City of Fort Worth, Texas tPct. eet aside a portion of the tax
levy for said Park Department of the City of Fort Worth for the years 1922,
1923 and 1924 for the purpose of paying and defraying the cost of the im-
provement as assessed against the Fort Worth Park Department of the City of
Fort Worth.
NOW THEREFORE, be it further ordained by the said Board of Commissioners
of the City of Fort Worth, as follows; to-wit, that one-tenth (110) cent
on each one hundred dollars of the tax levy for the year 1922, one-tenth
(1/10) of one cent on each one hundred dollars of the tax levy for the year
1923 and one-tenth (110) of one cent on each one hundred dollars of the
tax levy for the year 1924 out of the tax levy for the Park Department of
the City of Fort Worth for the several years aforesaid, be set aside and
applied to the payment of the assessment made against said Park Board of
the City of Fort Worth.
That out of the above sums so set aside for payment for the im-
provement and paving of said streets in front of Circle Park, there
shall be paid to said Texas Bitulithic Company on the 15th day of
October, 1922, the sum of $462.15 and all accrued interest, and on
the 15th day of Oetober 1923, the sum of ( $462.15) and all accrued
interest, and on the 15th day of ActOof 1924 all of the remaining
amount of principal, and accrued interest; all sums bearing eight per
cent per annum interest, from date of acceptance of said improvement
and paving by the said Board of Commissioners, provided that the
right is reserved to the city to pay any of said sums before maturity
at its option out of any funde which may be available.
That the accounts hereby set aside for the purposes herein
stated shall constitute a special and sacred fund for the purpose of
paying for said pavement, and shall be appropriated for no other pur-
pose.
That this ordinance shall take effect from and after its
passage.
MINUTES OF THE MEETING
OF THE FORT WORTH PARK BOARD HELD ON April 20th 1922.
BE IT RESOLVED by the Fort Worth Park Board in session assembled
and held on April 20th 1922, there being present, ami-.4a

THAT WHEREAS, the City of Fort Worth, Texas has heretofore direct-
ed and ordered the improvement and paving of Lincoln Avenue between
Central Avenue and Circle Park Avenue in the City of Fort Worth, Texas,
and has entered into a contract with the Texas Bitulithic Compapy for
the construction of said improvement and paving. AND WHEREAS the Board
of Commissioners of the said City did levy an assessment against the
Fort Worth Park Department for the paring said Avenue in front of Circle
Park fronting 200 feet on said Lincoln Avenue amounting to $1386.44,
and interest thereon not to exceed eight per cent per annum from date
of completion and acceptance of the paving. AND WHEREAS it is to the
best interest of the Park Department and City in general that said im-
provement and paving of said Avenue in front of said Circle Park be im-
proved and paved along with the rest of said Avenue, and the Park Depart-
ment should pay its pro rata part of the cost for the improvement and
paving of said Lincoln Avenue in accordance with the assessments levied
against it by the Board of Commissioners of the City of Fort Worth.
THEREFORE BE IT FURTHER RESOLVED that the Chairmanof the Park Board
be directed to request the Board of Commissioners of the City of Fort
Worth, Texas, to set aside a portion of the tax levy for said Park De-
partment of the City of Fort Worth for the years 1922, 1923 and 1924 for
the purpose of paying the cost of the improvement ass assessed against
the Fort Worth Park Department of the City of Fort Worbh, Texas.
AND BE IT FURTHER RESOLVED that the Chairman of the Park Board
and its Secretary be and it hereby directed and authorized to execute
a written contract with the said Texas Bitulithic Company obligating
and binding the Park Department of the City of Fort Worth, Texas, to

pay the said assessments, as above stated, payable as follows; $462.15
on "October 15th, 1922 and $462.15 payable on 46tahs* 15th, 1923, and
the balance payable on :Qctobar, 15th, 1924, with interest from date of
completion and acceptance of said paying at eight per cent per annum,
with the option of paying all of it at any time the said Park Department
may so desire, and to secure the payment of said assessment in accordance
with the said Qrdinance levying said assessment, give a lien on the prop-
erty known and described as Circle Park.
