AN ORDINANCE PROVIDING THAT A PORTION OF PECAN STREET AND A PORTION OF EAST NINTH STREDT, IN THE CITY OF FORT WORTH, TEXAS, SHALL BE PERMANENTLY CLOSED, ABANDONED AND VACATED TO PUBLIC USE; RESERVING ALL RIGHTS RELATIVE TO THE IN- STALLATION, CONSTRUCTION, MAINTENANCE, REPAIR OR INSPEC- TION OF ALL RAILWAY TRACKS AND UTILITY LINES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EF- FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT "FORTH, TEXAS: SECTION 1. That the following described lot, tract or parcel of land situated in Tarrant'County, Texas, is hereby closed, abandoned and permanently va- cated as a street or public thoroughfare: All of that portion of Pecan Street from the southerly line of East Seventh Street to the northerly line of Seventeenth Street, save and except a strip of land 60 feet in width for right of way for the new street connecting East Eighth Street and East Ninth across Grove Street and Pecan Street. SECTION 2, That the following described lot, tract or parcel of land situated in Tarrant County, Texas, is hereby closed, abandoned and permanently va- cated as a street or public thoroughfare: All of that portion of East Ninth Street described by metes and bounds as follows: Beginning at a point in the southerly line of East Ninth Street and the westerly line of the G. C. & S. F. Railway Companyrs right of way, said point being 83.5 feet easterly from the easterly line of Grove Street produced southerly across Ninth Street; thence in a northerly direction along the westerly line of the G. C. & S. F. Railway Companyts right of way if produced northerly to a point in the norther- ly ortherly line of East Ninth Street; thence in an easterly direc- tion along the northerly line of East Ninth Street to a point in the southerly line of the new street connecting East Eighth Street and-East Ninth Street across Grove Street and Pbcan Street; thence in an easterly direction parallel to and 30 feet southerly from the center line of the new street connecting East Eighth Street and East Ninth Street across Grove Street and Pecan Street to a point in the center line of East Ninth Street; thence in a southeasterly direction to a point in the southerly line of East Ninth Street, said point being at right angles to and 9 feet easterly from the center line of the C. R. I. & G. Railroad Company's easterly railroad track; thence in a westerly direction along the southerly line of East Ninth Street to the place of beginning. SECTION 3. All rights, title and interest in and through said premises described in Sections 1 and 2 relative to the installation, construction, mainte- nance, repair or inspection of all utility lines, including therein rail- way tracks, water, gas, electric lights and sewer, sanitary and storm sewers, are hereby expressly reserved. SECTION 4. All ordinances or parts of ordinances in conflict herewith are here- by expressly repealed. SECTION 5. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
