ORDINANCE NO.
AN ORDINANCE PROVIDING THAT A PORTION OF CHILDRESS
STREET, A PORTION OF THE INTERSECTION OF HARDEMAN
AND MILLER STREETS, AND A PORTION OF THE NORTH-SOUTH
ALLEY IN BLOCK 9, TRUE ACRES ADDITION TO THE CITY
OF FORT WORTH, TARRANT COUNTY, TEXAS, BE VACATED,
ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF
THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That the portion of Childress Street from Miller Street
west a distance of 226.5 feet be and the same is hereby closed,
abandoned and permanently vacated as a street or public thorough-
fare of any kind or character whatever, save and except that
easements are reserved for any and all existing utilities.
That the following described portion of the southwest
corner of the Hardeman-Miller Street intersection be and the
same is hereby closed, abandoned and permanently vacated as
a street or public thoroughfare of any kind or character whatever:
A tract of land out of the C. T. Hilliard Sur-
vey in the City of Fort Worth, Tarrant County, Texas,
and being a part of Hardeman and/or Miller Streets
at the southwest corner of the intersection of said
streets and being at the northeast corner of Lot 11-R,
Block 9, True Acres Addition, which tract is more
particularly described as follows:
Beginning at a point in the south line of Hardeman
Street at 76.5 feet east of the northwest corner of
said Lot 11-R, Block 9, True Acres Addition, said point
being the beginning of a curve to the right with a
radius of 140 feet;
Thence east along the north line of Hardeman Street
extended 140 feet to the intersection with the west
line of Miller Street;
Thence south along the west line of said Miller
Street 140 feet to a point 145.8 feet north of the
southeast corner of said Lot 11-R, Block 9, True Acres
Addition, said point being the end of the above men-
tioned curve;

Thence northwesterly along said curve 211.7 feet
along the northeasterly line of said Lot 11-R, Block 9,
True Acres Addition, to the point of beginning.
That the south 122.5 feet of the north-south alley in
Block 9, True Acres Addition, and the small triangular por-
tion of said alley at the northeast corner of said south
122.5 feet be and the same is hereby vacated, closed and
permanently abandoned as an alley or public thoroughfare of
any kind or character whatever.
SECTION 2.
That the interest of the City of Fort Worth in the fee
to the land in said streets and alley is hereby released and
shall revert to the adjacent owners of the fee as provided by
law.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage.

Messrs. Claude Boshart and T. M. Yancey, Jr. , owners of all adjoining property, At 1149AUG
have requested the vacation of the public right-of-way as indicated on the at-
tached map and as described below:
1) Childress Street - From Miller Street west a distance of 226.5 feet
2) North-south alley in Block 9, True Acres Addition - South 122.5 feet
3) Small triangular portion of alley - at the northeast corner of the
above alley vacation
4) Portion of Hardeman Miller Street intersection - Southwest corner
The abandonments will permit enlargement of an existing food store located on
Lot 11-R, and will permit expansion of the existing off-street parking facili-
ties. City departments and private utility companies have reviewed the request
and have no objections to the proposed vacations, provided Childress Street is
retained as an easement for access and existing utility facilities.
Opposition to the proposed abandonment of a portion of Childress adjacent to
the food store was expressed before the Plan Commission by Mr. Martin Siegmund,
attorney for Mr. Jack Hargis, 4101 Childress Street (Lot 19, Block 9, True Acres
Addition). Mr. Hargis opposes the closing of a portion of Childress Street be-
cause his residence fronts on the portion of Childress which will remain open
between the Poly Freeway and the proposed food store parking lot. Dedication
of an access easement in the Childress Street right-of-way to Miller Street
across the food store parking lot would permit east and west access to Mr.
Hargis' property.
The City Plan Commission has reviewed the request and recommends adoption of an
ordinance that has been prepared vacating the public right-nf-ways as requested
subject to the following conditions:
1) Construction of a standard 30-foot driveway entrance across Childress Street
at both ends of the vacated portion and provision of a 20-foot access ease-
ment from Miller to the remaining portion of Childress Street, in a manner
as may be prescribed by the Traffic Engineer.
2) Retention of the entire width of Childress as an easement for existing water,
sanitary sewer facilities and gas lines.
3) Filing of a replat showing required easements and vacation of Lots 11, 12,
13 and 14.
The applicants have submitted a replat dedicating the necessary utility easements
and vacating the lots as requested by the Plan Commission. The applicants have
also agreed to construct driveways and provide access as requested.

of Fort Worth, Tarrant County, Texas, and being a part of
Hardeman and or Miller Streets at the S. W. Corner of the
intersection of said Streets and being at the N. S. Corner
of -Lot 11-R, Block 9, True Acres Addition to Fort Worth,
and being described as follows:
BEGINNING at a point in the South line of Hardeman Street at
76.5 feet East of the N. W. Corner of said Lot 11-R, Block 9,
True Acres Addition, said point being the beginning of a
curve to the Right with a radius of 14.0.0 feet;
THENCE East along the North line of Hardeman Street extended
140 feet to the intersection with the West line of Miller
Street;
THENCE South alongthe West line of said Biller Street 140.0
feet to a point 15.8 feet North of the S. E. Corner of said
