ORDINANCE NO. � ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF DAVIS AVEIME AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH UN-ARAL CONSTRTrTION COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with GENERAL CONSTRUCTION COMPANY for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. DAVIS AVENUE. From the oast lino of Riverside Drive to the west line of Ash Crescent Street, kno%n and designated as Unit 1, Project No. 104-24000-•152. 2. DAVIS AVENUE: From the west lino of Ash Crescent Street to the west lino of Bolzise Terrace, known and-Aesignated as Uhit 2, Project No. 104-24004-152. 3. MULKEY STREET: From the oast lino of Beverly Avenue to 2501 East, known and designated as Unit 3, Project No. 105-24000»152. 4. FIFTH AVEhTCF: From the north lino of Lowe Street to the south line of Devitt Street, known and designated as Unit 4, Project No. 104-24000-152. 5. FIFTH AVENUE: From the south line of Devitt Street to the south line of High Street, known and designated as Unit 5, Project No. 104-24000-.152. 6. SHAW STREET: From the east line of Fifth Street to 3501 West, known and designated as Unit 6, Project No. 104..24000-152. 7. DICKSON STREET: From the oast line of Now Orleans Street to the west line of Evans Avenge, known and designated as Unit 7, Project No. 104-24000-152. 6. SIXTH AVENUE: From the north line of Gambroll Strout to the south line of Boddell Street, known and designated as Unit 6, Project No. 104-24000-152. 9. RYAN AVENUE: From the north line of Faller Avenue to 1401 North, known and designated as Unit 9, Project No. 104-24400..152. 10. SIXTH AVENUE: From the north line of Fuller Avenue to the loath line of Spurgeon Street, known and designated as Unit 10, Project No. 104-24000-152. 11. STANLEY AVENUE; From the south lino of Yates Street to 450, South, known C and designated as Unit 11, Project No. 10424000-152. 12. WALTON AVENUE: From the oast lino of Colusa Drive to 7751 East, known and designated as Unit 12, Project No. 104-24000-152. WHEREAS, by sundry proceedings heretofore passed by the City Council of the ",ity of Fort Worth, Texas, including Ordinance No. _��6 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting cn each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 56g6 1.. and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT Io The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. IIo The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective Parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows, zII. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Compliance with Specifications During testing on this project, 52 curings were made with the following results: Exceeds Even With Under Specs But Below Paving Specs Specs Within Tolerance Tolerance Surface 32 13 7 0 Base 22 30 0 0 On this entire project, the average thickness of the base course is 6.1 inches as compared to 6.0 inches specified and 4.12 inches as compared to 4.0 inches specified and the hot mix asphaltic concrete surface is 6.26 inches as compared to 6.0 inches specified. Tests made during construc- tion of sub-grade, base, and pavement show that materials used were in compliance with specifications.
