AN ORDINANCE REGULATING THE OPERATIONS OF TAXI-
CABS, BUSES AND OTHER VEHICLES FOR HIRE ON PUB-
LIC STREETS BY AMENDING CHAPTER 34, SECTIONS
34-9 AND 34-20, OF THE CODE OF THE CITY OF FORT
WORTH, TEXAS, 1964, AS AMENDED; BY REDUCING STREET
RENTAL FEES; BY REMOVING RESTRICTIONS AGAINST BEER,
LIQUOR AND POLITICAL ADVERTISING; MAKING THIS
ORDINANCE CUMULATIVE OF ALL PRIOR ORDINANCES; RE-
PEALING CONFLICTING ORDINANCES; PROVIDING A SEVER-
ABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Chapter 34, Section 34-9, of the Code of the City
of Fort Worth, Texas, 1964, as amended, is hereby amended
and, after having been so amended, shall hereafter read as
follows:
Sec. 34-9. Same -- Fee; when fee payable.
As compensation or rental or license fee for
the privilege of operating upon and using the
public streets, alleys and thoroughfares of the
City in conducting and carrying on the business
of transporting passengers for compensation on
and over such streets and thoroughfares in taxi-
cabs, each holder of a franchise or grant made
under the terms of this Chapter shall pay to the
City at the office of the Commissioner of Ac-
counts an amount equivalent to one per cent of
the gross revenues derived from the operation of
taxicabs operated by him, which amount shall be
paid monthly for each calendar month on or before
the fifteenth day of each succeeding calendar
month. The compensation provided for herein
shall be in lieu of all other fees to be paid
by taxicab operators imposed by any other ordi-
nance now in force, but shall not be construed
to be in lieu of any validly assessed ad valorem
taxes. (Ord. No. 5343, Section 1.)
SECTION 2.
That Chapter 34, Section 34-20, of the Code of the
City of Fort Worth, Texas, 1964, as amended, is hereby
amended and, after having been so amended, shall hereafter
read as follows:
Sec. 34-20. Advertising; name of owner
to be on cab.
Commercial advertising or commercial adver-
tising devices may be placed on, upon or in
any taxicab operated pursuant to the terms of
this article. Each taxicab shall have perma-
nently displayed on each side and the rear the
trade name of the operator. (Ord. No. 3909,
Section 1.)
SECTION 3.
This ordinance shall be and is hereby declared to be
cumulative of all other ordinances of the City of Fort Worth
providing for the regulation of motor vehicles upon the pub-
lic streets, and this ordinance shall not operate to repeal
or affect any of such other ordinances except insofar as the
provisions thereof might be inconsistent or in conflict with
the provisions of this ordinance, in which event such conflict-
ing provisions, if any, in such other ordinance or ordinances
are hereby repealed.
SECTION 4.
If any section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be unconstitutional,
such holding shall not affect the validity of the remaining
portions of this ordinance, and all of the remainder of this
ordinance not so held to be unconstitutional shall continue to
be in full force and effect.
SECTION 5.
This ordinance shall take effect and be in full force
and effect from and after its passage

On August 23, 1971, the City Council discussed the financial condition of the
taxicab companies operating in Fort Worth, and considered the request of the
Fort Worth Cab and Baggage Company that it be permitted ,to reduce its gross
receipts "street rental" payments and to be permitted to display on its
taxicabs liquor and political advertising, which is now prohibited by
ordinance. The Council directed that an ordinance be prepared implementing
the requested changes. The Department of Law has prepared an ordinance which
reduces to one per cent of gross receipts the street rental payment for taxi-
cab companies operating in Fort Worth, and eliminates any regulation regard-
ing the subject matter to be advertised on taxicabs.
City Council action on the ordinance described above is requested.
