FIRST RENEWAL AND AMENDMENT OF CITY SCRETARY CONTRACT NO. 46392,
AN INTERLOCAL AGREEMENT BETWEEN FORT WORTH
INDEPENDENT SCHOOL DISTRICT AND
THE CITY OF FORT WORTH
THIS FIRST RENEWAL AND AMENDMENT OF CITY SECRETARY CONTRACT NUMBER
46392 ("First Renewal and Amendment") is by and between the CITY OF FORT WORTH ("City"), a
home-rule municipal corporation of the State of Texas, and the BOARD OF TRUSTEES of the FORT
WORTH INDEPENDENT SCHOOL DISTRICT ("FWISD"), a political subdivision of the State of
Texas and a legally constituted Independent School District.
This First Renewal and Amendment is made under the authority granted to the City and the
FWISD by and pursuant to Chapter 791 of the Texas Government Code, known as the Interlocal
Cooperation Act.
WHEREAS, teachers, students, parents, and community members have identified increased
academic and cultural enrichment activities outside the school day as a major need;
WHEREAS, the City and FWISD executed an agreement for the City to provide after school
programming at Daggett Middle School, said agreement being Fort Worth City Secretary Contract No.
46392 ("Agreement");
WHEREAS,the Agreement provides for an initial one-year term with five (5), one-year renewal
options;
WHEREAS,the parties desire to exercise the first,one-year renewal option;
WHEREAS, the parties also wish amend the Agreement to revise the funding amount from
$48,000.00 to$41,705.00;
NOW, THEREFORE, the City and FWISD hereby agree to renew and amend the Agreement as
follows:
I.
Renewal
The City and FWISD agree to renew and extend the Agreement for a first renewal term of one
year, effective beginning on August 1,2015 and ending on July 31,2016("First Renewal Term").
H.
Amendment
The parties wish to amend Section 2.1 of the Agreement titled"FUNDING"to revise the amount
of funding that the City receives under the Agreement for the operation of the After School Program at
Daggett Middle School as it pertains to the First Renewal Term and any subsequent renewal term (unless
modified further by written agreement of the parties). Section 2.1 is amended to read as follows:
"FWISD agrees to pay the City annually Forty-One Thousand Seven Hundred Five
Dollars and No Cents ($41,705.00) to fund the operation of the Program at Daggett
Middle School. FWISD and the City agree that these amounts fairly compensate the City
for the operation of the Program. FWISD covenants and agrees that the funding for this

Agreement shall not include any money originating from the City, including, but not
limited to,funds from the City's Crime Control and Prevention District."
III.
Miscellaneous
1. All other terms and provisions of the Agreement between the City and the FWISD shall
remain in full force and effect except as specifically amended or set forth herein.
2. All terms in this First Renewal and Amendment that are capitalized but not defined shall
have the meanings assigned to them in the Agreement.

HEARING:
SUBJECT: Authorize Execution of a First Renewal and Amendment to City Secretary Contract No.
46392, an Interlocal Agreement with the Fort Worth Independent School District to
Operate the Fort Worth After School Program at Daggett Middle School, to Extend the
Term for an Additional Year and to Revise the Funding to an Amount Up to $44,213.00
and Adopt Appropriation Ordinance (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of the First Renewal and Amendment to City Secretary Contract No.
46392, an Interlocal Agreement with the Fort Worth Independent School District to operate the Fort
Worth After School Program at Daggett Middle School, to extend the term for an additional year
effective from August 1, 2015 through July 31, 2016 and revise the funding to an amount up to
$44,213.00; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the Grants Fund in the amount of$44,213.00.
DISCUSSION:
The City is currently a party to an agreement with the Fort Worth Independent School District
(FWISD) to provide after school programming at Daggett Middle School (City Secretary Contract No.
46392, M&C C-27051). The initial term of the Agreement is for one year and includes five, one-year
renewal options. The initial term expires on July 31, 2015 and staff recommends exercising the first,
one-year renewal option to be effective from August 1, 2015 through July 31, 2016, The FWISD
desires to revise the amount of funding that the City receives under the Agreement to fund the
operation of the After School Program at Daggett Middle School for the first renewal term from an
amount of$48,000.00 to an amount of$44,213.00.
Since 2004, the City, through its Parks and Community Services Department, has been designated
by FWISD to operate the 21st Century Community Learning Center Program (CLC) at Rosemont and
Daggett Middle Schools. The purpose of the CLC, which is supported through funding by the U.S.
Department of Education, is to provide academic enrichment programs and other activities to
reinforce and complement the regular academic schedule of participating students. CLC funding for
these sites ended after the 2013 school year due to the completion of Grant Cycle 6. FWISD has
opted to continue to fund efforts at Daggett Middle School through the FWISD's general fund with the
intent that the same purposes of the CLC be carried forward through its After School
Program. Rosemont Middle School has opted to provide a site-based program, led by school staff, in
lieu of a community-based provider.
The City will receive�the 44,213.00 for the After School Program at Daggett Middle School. The
FWISD will reimbursity thro ugh its general funds based on actual expenditures, not budgeted
amounts.

The Financial Management Services Director certifies that upon approval of the above
recommendations and adoption of the appropriation ordinance, funds will be available in the current
operating budget, as appropriated, of the Grants Fund. Prior to expenditure being made, Parks and
Community Services Department, has the responsibility to validate the availability of funds.
