CONNOR SURVEY, ABSTRACT NO. 288, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN INSTRUMENT NO. D211310331 OF THE REAL PROPERTY RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 21,966 SQUARE FEET OR 0.504 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Rutledge Street, a variable width right-of-way, situated the W.B. Connor Survey, Abstract No. 288, City of Fort Worth, Tarrant County, Texas according to Instrument No. D211310331 of the Real Property Records of Tarrant County, Texas, containing approximately 21,966 square feet or 0.504 acre of land more or less, and as more specifically described in Exhibits "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. B. Conner Survey,Abstract No. 288,Tarrant County, Texas, and being a portion of Rutledge Street, a variable width public right of way. The bearings for this survey are based on the bearings as they appear in Instrument No. D211310331, Deed Records, Tarrant County,Texas. Said 0.504 acre tract of land described by metes and bounds as follows: BEGINNING at a %z" iron rod with plastic cap stamped"RPLS 4818"set at the southwest corner of Lot 5, G.W. Adopt the attached ordinance vacating a portion of Rutledge Street, to be replatted by Witcher Properties and Nancy Nevvbernvvith the adjoining oonnnnero)o/ developments for additional parking; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Whitfield Hall Gun^ayoro. Inc., on behalf ofWitcher Properties and Nancy Nawbern, has requested the vacation of this portion of Rutledge Gtnaet, to be rep|atbyd with the adjoining commercial developments for additional parking. The City Plan Commission recommended approval of this request at its meeting on February 25. 2015. An acceptable final plat (FS-1 5-095) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the hght-of-way and did not expend any City funds topurchase the hght-nf-woyeasement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-1 5624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-vvay easements for the streets and alley.
