HANSBROUGH SURVEY, ABSTRACT NO. 747, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN INSTRUMENT NO. D214048856 AND D214264349 OF THE REAL PROPERTY RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 0.060 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Park Vista Boulevard situated the J.L. Hansbrough Survey, Abstract No. 747, City of Fort Worth, Tarrant County, Texas according to the plat recording in Instrument No. D214264349 of the Plat Records of Tarrant County, Texas and also being a portion of a deed conveyed to the D.R. Horton-Texas, LTD, recorded in Instrument No. D214048856 of the Real Property Records of Tarrant County, Texas, containing approximately 0.060 acre of land more or less, and as more specifically described in Exhibits "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. Park Vista ROW Vacation(VA-15-021) Ordinance No. 21958-11-2015 Page 1 of 2 All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION S. That this ordinance shall take effect upon adoption. Horton-Texas, LT[), with the Adjoining Residential Lots (COUNCIL DISTRICT 7) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating o portion of Park Vista Bou|ovand, to be nmp|atted by O.R. Horton-Texas, LTD, with the adjoining residential lots; and 3. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Pape Dawson Engineers, Inc., on behalf of D. R. Horton - Taxea. LTD, has requested the vacation of this portion of Park Vista Bou|evard, to be rep|atted with the adjoining residential lots. The Transportation and Public Works Department is installing a roundabout at the intersection of Park Vista Boulevard and Ray VVhiha Rood and this portion of Park Vista Boulevard was formerly dedicated fora free right turn lane that is no longer required. The City Plan Commission recommended approval of this request at its meeting on August 26, 2015. An acceptable final plat /F8-15-101\ has been naoaivod in accordance with the Subdivision Ordinance. The City 8f Fort Worth (City) originally obtained the 8bOV8 mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-1 5624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way a000monto for the streets and o|iay. This project is located in COUNCIL DISTRICT 7, K8ap00022C).
