AHEREAS, The City of Fort North, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and puhlic places in the City of Fort Wrth, Texas, be improver' by raising, gradin . or filling same and by constructing thereon to-wit: 1. Miller-Oakland Unit No. 2 anC 3, 7" reinforced concrete pavement on a 601 roadway. The above, together with combined concrete curbs and gutter on proper grade and line where same are not already so constructed, together .pith storm trains ane other necessary inci- dentals and appurtenances; all of said improvements are to be so constructed as and where shown on the plans and in strict accordance with the Plans and Specifications therefore; and contract has been made and entered into with orth Construction Company for the making and construction of such improvements; said portion of streets, avenues and public places begin as follows, to wit: 1. Miller-Oakland From Rosedale Street to the north line of Lot 1, block 4, Eastover A60tion, known and designated as Unit No. 2. 2. Miller-Oakland From Burton Street to the north line of Lot 1,Slock 4, Eastov r Addition, known and designates: as Unit No. 3. WHEREAS, estimates of the cost of the improvements of each such portion of street, avenue and public place were prepared and filed and approved and adopted by the city council of the City, and a time and place was fixer for a hearing to the proper notice of the time and place fixed therefor, to-wit, on the 15th day of October, 1962, 9:00 A. 1,4, in the Council Chanter in the City Hall in the City of Fort forth, Texas, anC at such hearing the following protests and objections were made, to wit: protested that protested that protested that protested that protested that protested that _ protested that protested that and said hearing, was continued to the present ti.,e in order to ;_rare fullyaccorplish the purposes thereof, and all desiring to be heard were given full and fair opportunity to be heard, and the City Council o: the City having fully considered all proper matters, is of the opinion that the said hearing, shoulu be closed and assessments should be made and levied as herein ordered: : OLS THEREFORE: BE IT ORDAINED BY THE CITY CLU MIL 01= T r_ CITY OF FORT iORT-, TEXAS, THAT: I. Said hearing be, and tKe sane is i-areby, closed and the said protest and objections, and any and all other protests and oujections, whether herein enumerated or not, be and the sa. e are hereby, overruled. II. The City Council, fror the evidence, finds that the assessments herein levied should be made and levied against the respective parcels of property abutting upon the said portions of streets, avenues and public places and against the owners of such property, and that such assess7ents an. charges are right and proper and are substanjaai7 y in proportion to the benefits to the respective parcels of property by means of the i,provements in the unit for which such assessments are levied, and establish substantial justKand equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits receive and burdens Vposed, and further finds that in eac> case the abutting property ass_ssed is specially benefited in enhanced value to the said property by means of the said improvements in the unit upon which the particular pro- perty abuts and for which: assess..ent is levied and charge mace, in a sun in excess of the said assessccent and charge mace against the sa .e by this ordinance, and further finds than the apportienwent of the cost of the irprove encs is in accordance with the law in force in this City, and the proceedings of We City heretofore had with reference to said improvements, and is in all respects valid and regular. III. There shall be, and is hereby, levied and assessed against the parcels of property herein below mentioned, and against the real and true owners thereof (whether such owners be correctly named herein or not), the sums of money itemized below opposite the description of the respective parcels of property and the several amounts assessed against the same, and tine owners thereof, as far as such owners are known, being as follows, towit: -2- IV. Adhere more than one person, firm or corporoiicn cons an interest in any property above described, each said person, fin. or corporation shall he personally liable only for its, her or his pro rata of the total assessment against such property in pro- portion as its, his or her respective interest bears to the total ownership of such pro- perty, and its, his or her respective interest in such property may be released frcT the assess• ent lien upon payment of such proportionate sum. V. The several sons above mentioned and assessed against the said parcels of property, and tie owners thereof, and interest thereon at the rate of six per cent (6%) per annum, together with reasonable attorney's fees and costs of collection, if incurred, are hereby declared to be and are ~.ale a lien upon the respective parcels of property against which the same are assessed, and a personal liability and charge against the real an: true owners of such property, whether such owners be correctly named herein or not, and the said liens shall be and constitute the first enforceable lien and clain against the property on which such assessments are levied, and shall he a first and paramount lien thereGn, superior to all other liens and clai::;s, axcept State, County, School District and City ad valorem taxes. The sums so assessen against the abutting property and the owners thereof shall be and becopa due anti payable as follows, tc-wit: in five (5) equal installments, due respectively on or before thirty (30) days, one (1), two (2), three (3), and four (4) years fro: the date of completion and acceptance cf the i provenents in the respective unit, and the assessments against the property abutting upon the remaining units shall be and becone due and payable in such installments after the date of the completion and acceptance of such respective units, and shall bear interest irc: said date at the rate of six per cent (Q) per annum, payable annually with each instalVent, except as to the first installment, which shall be due and payable at 0e raturity thereof, so that upon the completion and acceptance of the iqprovements in a particular unit, assessments against the property abutting upon such completed and accepted unit shall bc ann become sue and payable in such installments, and with interest fron the date of such ccampletion and acceptance. Provided, however, that any owner shall have the right to pay Q entire assess, ant, or any installnent thereof, before maturity by pay.ent of principal and accrued interest, an; provided further that if default shall be made in the payTent of any installment of principal or interest promptly as the same matures, then the entire aknunt of the assess ent upon which such default is made shall, at tine option of said City cf Fort North, or its assigns, be and become iqnedi- ately due and payable, and shall be collectible, together -ith reasonable attorney's fees and costs of collection, if incurred, PAMDEj, however, that acting through its duly authorized Director of Public .forks the City of Fort Worth retains the right to authorize payne2t of the suras assessed against abuttln5 property upon such completed and accepted unit is not ore than forty-eight (42) equal regular nontAly installments of not less than $9.00 each, the first of such installoents to beccie due and payable not more than thirty (K) days after the completion and acceptance by the City of the particular unit. PROVIDED FURTHEA, that the City Attorney is hereby e:;powered to authorize paynents of said sums of lesser installments and/or over a longer period of ti.;e in cases in chick the Director of Public Works has previously 6eter-ined that an extreme financial hardship upon the property owner will otherwise result; and PaCV13ED FUi�711i]Hq that such method of payments shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed arms delivered to the City of Fort North a lawful, valid and binding note and mechanic's and material on's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said abutting property in trust to secure the pay�ent by said owner or owners according to the terns thereof of the sums assessed against such property. VI. If default shall be waie in the payment of any assessment, collection thereof shall be enforced either by the sale of the property by the :assessor and Collector of Taxes of said City as near as possible in the manner provided for the sale of property for tLe non- pay ent of ad valorem taxes, or at the option of the City of Fort vVorth, or its assigns, payment of said sums shall be enforced by suit in any court of competent jurisdiction, or as provided in any mechanic's or materialman's contract as aforesaid, and said City shall exercise all of its lawful powers to aid in the enforcement and collection of said assessments. -3- VII. The total amount assessed against the respective parcels of abutting property, and the owners thereof, is in accordance with the proceedings of the City relating to said improvements and assessments thereof, and is less than the proportion of the cost allowed and permitted by the lar in force in the City. VIII. Although the aforementioned charges have been fixed, levied, and assessed in the respective amounts hereinabove stated, the City Council does herby reserve unto itself the right to reduce the afcre-.entionec asses&.ents by allc: ing credits to certain property owners More deemed appropriate. Notwithstanding the City Council has herein reserved the right to issue credits, it shall not be requires: to issue credits, and will not do so, if same would result in any inequity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of Fort Worth, Texas, as hereinafter provided, shall be fixed and determined by deducting from the amount of any assess ,ent hereinabove levies: such amount or amounts, if any, as may hereafter be allowed by the City Council as a credit against the respective assess;rents. IX. For the purpose of evidencing the several sums assessed against the respective parcels of abutting property and Oe owners thereof, and tKe time and ter.:s of payment, and to aid in the enforcement and collection thereof, assignable certificates in the principal amount of the respective assessr:ents less the amount of any respective credit allowed thereon, shall be issued by the City of Fort ,north, Texas, upon completion and acceptance by the City of the improvements in each unit of improvement as the work in such unit is completed and accepted, which certificates shall be executed by the mayor in the name of the City and attest- ed by the City Secretary, with the corporate seal of the City impressed thereon, and shall be payable to the City of Fort 'Worth, or its assigns, and shall declare the said counts, time and terms of payment, rate of interest, and the date of the completion and acceptance of the improvements abutting upon such property for which the certificate is issue6, and shall ccntah-. the name of the onner or owners, if known, description of the property by lot and block number, or front feet thereon, or such o0er description as may otherwise identify the sane; and if the said property shall be owned by an estate, then the description of same as so owned shall be sufficient and no error or Ostake in describing any property, or in giving the na' of tate owner, shall invalidate or in anywise impair such certificate, to the assess- ents levied. The certificates shall nrovioe substantially that if same shall not be paid pro:ptly upon maturity, then they shall be collectible, with reasonable attorney's fees and costs of collection, if incurred, ana shall provioe substantially that the amounts evidenced thereby shall be paid to the issessor and Collector of Taxes of the City of Fort north, Texas, who shall issue its receipt therefor, Aich shall be evidence of such payor nt on any 6e7and for the sane, and the Assessor and Collector of Taxes shall deposit the suKs so received by KLT forthwith with the City Treasurer t. be kept and held by hi. in a seperate fund, and when any payaent shall be kane to the City the _.ssessor and Ullector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said payment thereon. If such certificate be assiVned then Qo holder thereof shall be entitled to _re- ceive fro- the City Treasurer the amount paid upon. the Pres ntotion V hin of such certificate so endorsed and credited; and such emorseant an4 credit shall be the Treasurer's Warrant forsaking such nay..ent. Such payments by the Treasurer shall be receipted for the holier of such certificate in writing any by surrender thereof when the principal, together ith accrued interest and all costs of collection and reasonable attorney's fees, if incurred, have b<en paid in full. Said certificates shall further recite substantially that the proceedings with reference to �akina L e i•;orovements have been regularly had in co"pliance with the las:, and that all prerequisites to tKe fixing of the assessant lien agains! the property described in such certificate and the personal liability of the owners thereof have b=en performed, and such recitals shall be prim facia evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. -4- Said certificates may have coupons attached thereto in eviuer ce of each or any of the several installcents therecf, or _ay have coupons for each of the first four in- stallments, leaving the main certificate to serve for Go fifth installment, which coupons may be payable to the City of Fort With, or its assigns may be signed with the facsimile signatures of the Mayor and. City Secretary. Said certificates shall further recite that the City of Fort kith, Texas, shall exercise all of its lawful powers, when requested so to do, to aid in the enforcer.ient and collection thereof, and nay contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereof, and it shall not be necessary that the recitals be in the exact for: above set forth, but the substance thereof shall be sufficient. The fact that such i :prcveKents may be ouittel on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of suet assessents upon other premises. Full power to make and levy reassesscents and to correct mistakes, errors, invalidities or irregularities, either in the assessccents or in the certificates issued in evidence thereof, is, in accorSance with the lov in force in this City, vested in the City. U. All assessments levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named, or may be incorrectly named. XII. The assessments so levi-d are for the improvements in the particular unit upon which the property described abuts, anc, the assessments for the Kprovements in any unit are in nowise affected by the irprove,:ents or assess:ents in any ether unit, and in making assessoents and in holding said hearing, the amounts assessed for improvements in any one unit have been in nowise conn7cted with the improvements or the assessAents therefor in any other unit. Xiii. The assessments levied are made anc levied under and by virtue of the terns, powers and provisions of an Act passed at th• First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106 of ti•.e Acts of said Session and non shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been adopted as an a: endvent to and macre a part of the Charter of the City of Fort Aorth, Texas. NIV. The City Secretary= is hereby directed to engross and enroll this ordinance by copying the caption of same in the Kinute Bok of the City Council of Fort With, Texas, and by filing the complete Ordinancu in the appropriate Ordinance Records of said City. City Manager CITY OF FORT WORTH PUBLIC WORKS DEPARTMENT ENGINEERING DIVISION MILLER-OAKLAND WIDENING AND PAVING - CONTRACT II BURTON STREET TO ROSEDALE BENEFIT HEARING OCTOBER 15, 1962 SUMMARY OF ADMINISTRATIVE HEARING On September 24, 1962, the Engineering Division of the Public Works Department conducted an Administrative Hearing at S. S. Dillow Elementary School, on the Miller-Oakland Widening and Paving Project - Contract No. II, from Rosedale ' Street to Burton Street. Approximately 50 people attended the hearing. Contract No. I, from Lancaster to Hawlet is under construction. The overall program was outlined, giving the type of pavement, sequence of con- struction and the manner in which the assessments and credits were computed. A resume of the assessment paving policies of the City was presented and it was ex- plained that the 1958 Bond Election provided funds for the City's portion of this project, and that it was proposed to assess the adjacent property owners for a portion of the cost. The distribution of cost between the City at large and the adjacent property owners was given. This project was divided into two units, as follows: Unit II - From Rosedale Street south to the north line of Lot 19 Block 4, Eastover Addition. This unit has an existing old county road surface which is not to City grade. The assessments are based on the policy for new street construction, with a credit of $0.27 per front foot given for the existing asphalt surface. Unit III- From the north line of Lot 1, Block 4, Eastover Addition, to Burton Street. This unit has an existing asphalt surface which is on City grade and the property owners participated in the original cost. The only assessment on residential property is for curb and gutter where none exists at this time. On the other property, the assessment is for the widening and curb and gutter where none exists at this time. The majority of the property owners present were extremely opposed to any assess- ment. Many of the property owners voiced criticism concerning the fact that the City was widening the existing street in front of their property and that they were receiving no compensation. In all of these cases the right-of-way for the ultimate street improvements had been dedicated when the property was subdivided or had been reserved for street purposes when a tract had been replatted. The property owners are generally not aware of where the front property line of their property is located, and a thorough search of the City records and the deed records of Tarrant County was made in the preparation of an accurate right-of-way map of this section of Miller Street. There was a considerable amount of right-of-way purchased on this section of Miller which had not been previously dedicated or re- served.
