HomeMy WebLinkAboutOrdinance 7739 ORDINANCE NO. -.72 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF 721.076 ACRES (1.154 SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUND- ARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT THE TER- RITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PRO- VIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDI- NANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR SEVERABILITY AND NAMING AN EFFEC- TIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Cham- bers in the Municipal Office Building of Fort Worth, Texas, on the 25th day of April, 1978, which date is not more than twenty (20) nor ]Less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the herinafter described territory on the 14th day of April, 1978, which date was not more than twenty (20) nor less than ten (]0) days prior to the date of the public hearing; and WHEREAS, the population of the City of Fort Worth, Texas was in excess of 367,000 inhabitants on January 1, 1963 and in excess of 400,000 inhabitants on January 1, ]978; and WHEREAS, the corporate area of the City of Fort Worth, Texas was 152.580 square miles on January 1, 1963 and was 241.838 square miles on January 1, 1978; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory contains 721.076 acres (1.154 square miles) of land, more or less; -I- 10 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the bound- ary limits of the City of Fort Worth, Texas, and the present bound- ary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to in- clude said area within the corporate limits of the City of Fort Worth, Texas, to-wit: BEING 721.076 acres, located in Tarrant County, Texas 8.3 miles Southwest of the Tarrant County Courthouse out of the S.A. & M.G. Railroad Company, Abstract 1463 and the J. Jen- nings, Abstract 873 Surveys, and being more particularly des- cribed by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth City Limit Line, which point for corner is the West right-of-way line of the G.C. & S.F. Railway, 2500 feet South from the North right-of-way line of Sycamore School Road (County Road No. 1059) ; THENCE North 2 Degrees - No Minutes - 02 Seconds East along and with the Westerly right-of-way line of G.C. & S.F. Railway, to a point for corner which bears South 1 Degree - 52 Minutes West 1,782 feet from the intersection of said right-of-way line and the North line of the S.A. & M.G. Railroad Company Survey, Abstract 1463; THENCE North 89 Degrees - 53 Seconds West 1,641.5 feet to a point for corner; THENCE South No Degrees - 13 Minutes East 1,156.56 feet to a point for corner; THENCE North 89 Degrees - 58 Minutes West 3,236.1 feet to a point for corner; THENCE South 1 Degree - 08 Minutes West 317 feet to a point for the Southeast corner of the J. Williams Survey, Abstract No. 1599 and the Northeast corner of the E. Littlepage Survey, Abstract No. 971; THENCE South No Degrees - 44 Minutes West, along and with a property line lying in County Road, No. 1054 (West Cleburne Road , 4,560.3 feet to a point for the Southeast corner of the E. That the above described territory is shown on Exhibit Map A which is attached hereto and expressly incorporated herein by reference for the purpose of illustrating and depicting the loca- tions of the hereinabove described territory. SECTION 3. That the above described territory and the area annexed shall be part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 4. That thereafter the City Limit Line of Fort Worth shall be: A part of the J. Jennings Survey, Abstract 873, Tarrant Coun- ty, Texas, and being more particularly described as follows: BEGINNING AT A POINT FOR CORNER IN THE PRESENT Fort Worth City Limit Line, which point for corner is the West right-of-way line of the G.C. & S.F. Railway, 2,500 feet South from the North right-of-way line of Sycamore School Road (County Road No. 1059) ; THENCE Southerly, along and with the Westerly right-of-way line of the G.C. & S.F. Railway, approximately 2,400 feet more or less, to an iron pin in the Southerly fence line of a gravel road, same being point for corner; THENCE North 89 Degrees - 47 Minutes - 03 Seconds West 849.48 feet along the Southerly right-of-way fence of said gravel road to and along an old fence, same being the occupied South line of said J. SECTION 5. That this ordinance shall and does amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this ordinance shall be, and the same is hereby made cumulative. SECTION 6. That it is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any uncon- stitutional phrase, clause, sentence, paragraph or section. That this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. Further, in order to prevent the creation of an island of land in our ETJ (extraterritorial jurisdiction) that is totally surrounded by Fort Worth, additional property located to the north is included in the area recommended for annexation. The total area being considered in this request is 721.076 acres. (See attached Exhibit Map S In considering this request, a service feasibility report was prepared utiliz- ing City departmental comments to assist in determining the suitability of the area for annexation. Following receipt of the study report, the City Plan Commission held a public hearing on the area recommended for annexation as shown on the attached Exhibit Map "A". All affected property owners were notified. Three property owners appeared before the City Plan Commission Hearing on this matter held March 29, 1978. Twp of the property owners concurred that the initial zoning for the proposed annexation area should be "AG" Agricultural when and if the area is annexed. The City Plan Commission, following the hearing, unanimously recommended approval of both the recommended annexation area outlined on the Exhibit Map "A" and the initial "AG" Agricultural zoning. Also, attached is the staff study report on this area considered by the City Plan Commission. Plan Commission The following were major factors considered by the City Plan Commission in arriving at their recommendation to the City Council: 1. The 462 acre portion of the area is being purchased for development. 2. Water and sewer lines are located within a reasonable extension distance. 3. Development is now occurring in the immediate area. 4. Responding City Departments and the Development Review Committee do not idenfity any significant problems with the annexation and subsequent service to the proposed annexation area. The property appears to be suitable for development without major topographic or environmental constraints. 6. Annexation of the area would ensure quality development of its community facilities. Jurisdiction: The subject property is within the exclusive extraterritorial jurisdiction of the City of Fort Worth and not subject to annexation by any other city. There are no ordinance conflicts existing and no common boundary adjustments with other cities required for annexation. Since we have not annexed our maximum allowable in prior years, we are eligible to annex 30 percent of our corporate area, 72 square miles in this calendar year. Sector and District Plan: The subject area is located within the Wedgwood Sector and District H. The predominant use recommended in both plans for the subject property is low. density housing. A sizeable portion of the subject property is also recom- mended for cemetery use. Other recommended uses for the subject property are commercial, schools, public open space, fire station, and medium density housing. Arterial and collector streets are proposed through and adjacent to the subject property. Project Scope: It is anticipated that the 462.56 acres of Capsyn Limited property will be developed as a predominantly residential development with a moderate amount of commercial development at the McCart-Sycamore School Road inter- section. Also, included would be an elementary school site (Crowley I.S.D.) and an appropriate park. site. Therefore, based on the anticipated develop- ment pattern of the Capsyn Limited property, we project approximately 2338 lots at an estimated population of 7,104 for the total area being considered. At present there are four residential structures located within the subject property that is currently in agricultural or vacant land use status. Library: The library currently operates a bookmobile stop at Sycamore Elementary School on Country Manor Road. It is closer to the property under consider- ation than many branch libraries are to residents within the City itself. Service is limited to the school year because of little use by adults. Thirty hours of service are provided during ten stops. Economic Development: As no industrial development is anticipated at this time for the subject property, this office reserves comment until such time as industrial develop- ment is considered. Water and Sewer: Water - There is an existing 16 inch water main in McCart Street just south of West Cleburne Road. Initial service to areas developing in the proposed annexation area will probably be served by extension from that source. Supplementary supply will be afforded by extension from the 24 inch main in Sycamore School Road at West Cleburne Road, as development proceeds. Under current policy, any water mains constructed as approach mains for developments in the area will be constructed at developers expense. Based on current costs, it is anticipated that on-site water facilities costs will be distributed as .follows: Estimated Developer Cost: 2338 Lots @ 70` Frontage @ $8.60/Front Ft. _ $1,407,000 Estimated City Cost @ 25% of Developer Cost = 352,000 Total Estimated On- Site Costs $1,759,000 Sewer - The primary source of sanitary sewer service to the subject area will be the existing 18 inch sanitary sewer main located along Sycamore Creek, with an extension required in a westerly direction from a point just east of the MKT Railroad and just south of Sycamore School Road. Under current policy an extension of sanitary sewer mains constructed as an approach to developments within the subject area will be built at developer expense. Based on current costs, it is anticipated that on-site sanitary sewer facilities costs will be distributed as follows: 2 Estimated Developer Cost: 2338 Lots @ 701 Frontage @ $6.80/Front Ft. _ $1,113,000 Estimated City Cost @ 25% of Developer Cost = 278,000 Total Estimated On- Site Costs $1,391,000 Public Works: Sanitation - There are no immediate problems expected in the absorption of service of this area in its present undeveloped state. However, the 2338 lots under consideration will require a complete garbage crew, with capital outlay of $46,800 and annual operating cost of $47,420. In addition, $30,000 annually for collection of brush and bulky waste will be needed. Streets - The area contains 3.6 lane miles of rural penetration type roadways. F.M. Road 1054 south from the' north bovadary of the study area to its intersection with. F.M. Road 1059 is in poor condition. 7.14. Road 1059 east from F.M. Road 1054 for approximately 0.8 lane miles has numerous base failures. Both roads will require drainage work along the borrow ditches. It is anticipated that base reconstruction, penetration pavement repair, spot sealing and blading of shoulders and drainage ditches will be required during the next three years. The estimated cost of performing this maintenance work in the subject area over the next three years is as follows: First year $10,439 Second year - $ 7,750 Third year $ 8,396 Fire: The requested annexation is too far from present stations to be adequately served. By present access routes the distances from the current station are: (1) Station #26 - 3.3 to 4.5 miles (2) Station #28 - 3.03 to 4.7 miles (3) Station X117 - 4.73 to 6.25 miles. however, Station #29 (proposed) if located where previously recommended would be 1.35 to 3.6 miles from the subject property. With this development and others in this vicinity in the near future, another fire station should be located between Stations #26 and 928 considering the final site location of #29. 3 Park and Recreation: If the subject area within this annexation study is developed in compliance with the Sector and District Plans, there would be a need generated for approximately 17.5 acres of park land. This acreage requirement would consist of a park of approximately 5.0 acres adjacent to the proposed elementary school site in the northern portion of this area and a 12.5 acre park farther south. It may be assumed these parks would be acquired through the City's current Park Policy as subdivision development occurs. Park development would by necessity be funded through current or future bond programs with the possibility of matching federal funding. It is estimated that at 1978 prices, it would cost approximately $92,000 to adequately develop this acreage to neighborhood park standards. Initial park maintenance standards would require an additional maintenance truck, tractor mower and assorted minor equipment. This would require an initial capital expenditure of $20,000. At 1978 prices, the total park acreage in question upon development would require an increase in the annual maintenance budget of approximately $18,000. Police: The following are cost figures necessary to serve the proposed annexation area with police protection: Area Required Per Beat: 6.91 Square miles Area Involved: .167 of one beat I. Recurring Costs: $43,512 (three officers) 11 517$8 Ccost for vehicular mileage) Subs-Total $49,300 II. Non-recurring Costs: $ 7,000 (one vehicle) 30,000 (training) 2,543 (equipment) Sub-Total $39,543 III. Grand Total $889843 Traffic Engineering: Initially, since the area is mostly undeveloped grazing land with few streets except rural portions of McCart and Sycamore School Road, the only service required will be minor signing of street names, speed limits, stop signs, etc. It is estimated that these costs would not exceed $750 the first year. Annual costs after that time cannot be accurately estimated since a preliminary plat showing proposed development has not been submitted, and services will be provided only as development occurs. When the area fully develops, appro- priate street lighting, considerable signing, and perhaps signalization, will be required. 4 Public Health: The subject annexation request would not impose any appreciable cost to this department. However, it is recommended that this area be served by the City of Fort Worth water and sewer systems or an approved community water and sewer system, since the soil in this area is not suitable for septic tank installations. Development Review Committee: After some discussion, the Development Review Committee recommended unanimously that the subject annexation proposal be approved by the City Plan Commission. Conclusion: Responding City Departments and the Development Review Committee do not identify any significant problems with the annexation and subsequent service to the proposed annexation area. With water and sewer service feasible through relatively short extensions and development occuring in the immediate area, it appears that the area is ready for annexation in order to insure quality development. Further, this property appears to be suitable for development without topographic or environmental constraints. 5
