HomeMy WebLinkAboutOrdinance 16482-06-2005Ordinance No ! 6y~z Oro "~©®~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $395,139 93 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING MAINTENANCE AND REPAIR OF THE RADISSON PARKING GARAGE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $395 139.93 from available funds for the purpose of funding maintenance and repair of the Radisson Parking Garage SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS TO FORM AND LEGALITY Assistant City Attorney ADOPTED AND EFFECTIVE. ~,.ip 2~rr apQ,3 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 6/28/2005 Ordinance No. 16482-06-2005 DATE Tuesday June 28 2005 LOG NAME. 20GARAGE REFERENCE NO **G-14839 SUBJECT Approval of Appropriations Ordinance for Maintenance at the Radisson Parking Garage .* RECOMMENDATION It is recommended that the City Council: 1 Adopt the appropriations ordinance increasing estimated receipts and appropriations in the Grants Fund by $395 139 93 from available funds, and 2. Authorize the use of approximately $25 000 of these funds for repair of the Radisson Parking Garage leak. DISCUSSION On May 1 1979 (M8~C G-4150) the City Council authorized an application for Urban Development Action Grant (UDAG) funds from the U S Department of Housing and Urban Development (HUD) for acquisition of land and construction of a public plaza and atwo-level subsurface parking garage As a part of this application and in conjunction with the provision of the public facilities, Woodbine Development Corporation the development entity of Hunt Investment Corporation agreed to acquire, renovate and convert the historic Hotel Texas into a modern Hyatt Regency Hotel. As apre-requisite for final approval of the Grant Agreement, HUD required that the City and Hunt enter into an Agreement to Lease the parking facility On August 8 1979 (M&C C-4779) the City Council approved a 50-year lease between the City and Woodbine Development for the facility The parking garage was completed in November of 1981 In subsequent years the hotel was purchased by Radisson and the garage lease was assumed by Radisson. The terms of the lease make the City responsible for maintenance of the foundation the exterior walls, the roof and all other structural elements of the garage The garage facility has been experiencing significant water intrusion during periods of heavy rain Approximately $25 000 of repairs are needed The repairs include sealing of expansion joints at street level above the garage and cleaning of the storm drain system serving the garage In keeping with current practice the balance of the lease revenue will be used for housing activities as well as match funds for the federal HOME programs of Fort Worth. Upon approval of this M&C $25 000 of that lease revenue will be utilized from the Grants Fund to support the needed repairs.
