HomeMy WebLinkAboutOrdinance 16486-06-2005~l ORDINANCE NO. ~~ ~/~, -~~ -a.©oS AN ORDINANCE VACATING A 10 FOOT WIDE BY 150 FOOT LONG PORTION OF' MALVEY AVENUE ADJACENT TO LOTS 15 THROUGH 20, BLOCK 137 OF CHAMBERLIN ARLINGTON HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY TEXAS, AS RECORDED IN VOLUME 63, PAGE 21 OF THE PLAT RECORDS IN TARRANT COUNTY TEXAS, CONTAINING 1500 SQUARE FEET MORE OR LESS, PROVIDING FOR THE REVERSION OF FEE IN SAID LAND• THE RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a 10 foot wide by 150 foot long portion of Malvey Avenue adjacent to Lots 15 through 20, Block 137 of Chamberlin Arhngton Heights Addition to the City of Fort Worth, Tarrant County Texas, as recorded in Volume 63 Page 21 of the Plat Records in Tarrant County Texas, containing 1500 square feet, more or less, and as more specifically described in Exhibit A & `B" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That existing utility easements shall be retained by the City until such tune all utilities located in that easement are relocated at the owner's expense. SECTION 3. That the fee to the land in the above-described street and alley rights-of way is released and shall revert to the adjacent owner as provided by law SECTION 4. That all ordinances or parts of ordinances ui conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. I. ~I ! ~T 9 3t I Exhibk "B" ~ City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 6/28/2005 Ordinance No. 16486-06-2005 DATE Tuesday June 28 2005 LOG NAME. 06VA-05-014 REFERENCE NO PZ 2600 SUBJECT Adoption of Ordinance Vacating a 10-Foot Wide Portion. of Malvey Avenue Adjacent to Block 137 of Chamberlin Arlington ,.Heights Addition Street Right-of--Way Vacation VA-05-014 RECOMMENDATION It is recommended that the City Council adopt the ordinance vacating a 10 foot wide by 150 foot long portion of Malvey Avenue- adjacent to Lots 15 through 20 Block 137 of Chamberlin Arlington Heights Addition to the City of Fort Worth Tarrant County Texas, as recorded in Volume 63 Page 21 of the Plat Records in Tarrant County Texas, containing 1500 square feet, more or less. DISCUSSION Eric Walsh owner of adjacent property has requested vacation of the above referenced portion of Malvey Street in order to include the property within a replat for commercial development. The Engineering Department, Real Property Services Division states that the purchase fee of $100 has been received Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on April 27th,. 2005 Any existing utilities will be relocated at the applicant's expense.. An acceptable replat has been received (see FS-05-091 attached ) This request is located in COUNCIL DISTRICT 7 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
