Mike Goldman, with consent of Bob Marshall, owners of all abutting property,
RIMES ROBIN 3ON has requested that the City vacate Martin Lydon Street in the 2300 block
from the east right-of-way line of McCart Avenue eastward to the west line
of the north-south alley, as shown on the attached map. Martin Lydon Street
does not cross the railroad to the east of this location because of consider-
able difference in elevation.
The subject street right-of-way, acquired by dedication, is open, but unpaved,
and contains a telephone feeder cable for service to the area to the west. The
Public Works Department has requested that the street be physically closed with
curb and gutter, for which satisfactory arrangements have been made. City
departments and private utility companies have reviewed this request and have
no objections provided a satisfactory replat is submitted retaining the
vacated right-of-way as an easement. A satisfactory replat has been sub-
mitted to the City staff.
The City Plan Commission has reviewed this request and recommends that an
ordinance be adopted vacating the subject right-of-way as requested.
Recommendation
It is recommended that an ordinance be adopted vacating the subject right-
of-way as recommended by the City Plan Commission.
