AN ORDINANCE VACATING AND EXTINGUISHING A 26-FOOT
WIDE EMERGENCY ACCESS EASEMENT ON A PORTION OF
LOT 30, BLOCK 33 OF STONEGLEN AT FOSSIL CREEK
ADDITION SAID EASEMENT BEING ADJACENT TO THE
SOUTH PROPERTY LINE OF LOT 11, BLOCK 33 OF
STONEGLEN AT FOSSIL CREEK ADDITION TO THE CITY OF
FORT WORTH, TARRANT COUNTY TEXAS, AS RECORDED IN
VOLUME 388-202, PAGE 49 OF THE PLAT RECORDS IN
TARRANT COUNTY TEXAS, CONTAINING 3,802 SQUARE
FEET MORE OR LESS, PROVIDING FOR REVERSION OF FEE
IN SAID LAND• REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS
SECTION 1.
That a 26-foot wide emergency access easement on a portion of Lot 30, Block 33
of Stoneglen at Fossil Creek Addition. Said easement being adjacent to the south property
line of Lot 11 Block 33 of Stoneglen at Fossil Creek Addition to the City of Fort Worth,
Tarrant County Texas, as recorded in Volume 388-202, Page 49 of the Plat Records in
Tarrant County Texas, containing 3 802 square feet, more or less, and as more
specifically described in Exhibit A, attached hereto and incorporated herein by reference,
be and the same ~s vacated and extinguished.
SECTION 2.
That the fee to the land in the above described vacated utility easement is hereby
released and shall revert to the adjacent owner as provided by law
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.

SECTION 4.
That this ordinance shall take effect upon adoption.

RECOMMENDATION
It is recommended that the City Council adopt the ordinance vacating a 26-foot wide emergency access
easement on a portion of Lot 30 Block 33 of Stoneglen at Fossil Creek Addition Said easement being
adjacent to the south property line of Lot 11 Block 33 of Stoneglen at Fossil Creek Addition to the City of
Fort Worth Tarrant County Texas, as recorded in Volume 388-202, Page 49 of the Plat Records in Tarrant
County Texas, containing 3 802 square feet, more or less.
.DISCUSSION
Coy Landes of Landes & Assoc. acting an behalf of C L. Madden owner of adjacent property has requested
vacation of the above referenced portion of emergency access easement in order to include the property
within a replat to enlarge Lot 11 Block 33 for an enhanced residential building site.
The Engineering Department,. Real. Property Services Division states that the purchase fee of $1 00 has
been received
Reviewing City departments and public utility companies have raised no objections to this request. The City
Plan Commission recommended approval of this request at its meeting on May 25th 2005 Applicant is re-
dedicating. a 15-foot water easement and an 11-foot utility easement; any existing, utilities will be relocated
at the applicant's expense An acceptable replat has been received (see FS-05-106 attached )
This request is located in COUNCIL DISTRICT 4
