G 2 2 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF LONG AVENUE EXTENSION AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH J.L. BERTRAM CONSTR. & ENGR., INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS ]LEVIED➢ AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED) AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with J. L. Bertram Construction & Engr., Inc. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: LANG AVENUE EXTENSION: From Jacksboro Highway to N. W. 26th Street, known and designated as Unit 12, Project No. 104--23000-104, Contract 10. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 6015 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. - 6015 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,, TEXAS.9 THAT. I® The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. Ii. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secreta I ry is directed to attest same and impress thereon the corporate seal of the City, all in accordancewith the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of thetrueowners of the respective parcels of pro- perty assessed and shall he issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of thecertificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: IIYO When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price IV The City Secretary is hereby directed to engross and enroll this ordinance by copying_ the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the. appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Contract Awarded: September 23, 1968 (M&C C-1320) Work Order Issued: February 7, 1969 Work Order Effective: February 17, 1969 Date of Final Inspection and Approval: November 21, 1969 Working Time Bid: 120 Working Days Working Time Used: 126 Working Days Project Cost and Financing Original Bid Price: $310,383.37 Final Contract Cost: $305,512.36 Less Liquidated Damages: 6 Days at $100 per day =$600.00 Net Contract Cost: $304,912.36 Partial Payments Previously Made: 9 Amount: $274,961.12 Final Payment Due: $29,951.24 Final Payment to be Made from Project Account Number: 060-21301-4556 Deviation from Bid Price: An under-run of $4,871.01 occurred because of minor variations between quantities estimated in the contract documents and quantities measured and used at the job site. Compliance with Specifications During testing on this project, 49 corings were made with the following results: Exceeds Even With Under Specs But Below Specs Specs Within Tolerance Tolerance Paving 36 12 1 0 Sub-grade 12 37 0 0 On the entire project the average thickness of the concrete paving is 7.31 inches compared to the seven inches specified, and the average thick- ness of the lime stabilized sub-grade is 6.20 inches compared to the six inches specified. Tests made during construction show that materials used were in compliance with specifications. Recommendation It is recommended that the project described above be accepted by the adoption of an ordinance and that final payment of $29,951.24 be auth- orized to J. L. Bertram Construction and Fngineering, Inc.
