HomeMy WebLinkAboutOrdinance 16687-11-2005ORDINANCE NO. / lv~o ~'7 - ! ~ oZ®0.~ AN ORDINANCE VACATING A STRIP OF RIGHT OF WAY RUNNING SOUTH FROM THE NORTHWEST CORNER OF LOT 10 BLOCK 2 TO THE SOUTHWEST CORNER OF LOT 1 BLOCK 2 OF THE DRAUGHON HEIGHTS ADDITION AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY TEXAS AS RECORDED IN VOLUME 388-D, PAGE 179 PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a strip of right of way running south from the northwest corner of Lot 10 Block 2 to the southwest corner of Lot 1 Block 2 of the Draughon Heights Addition, an Addition to the City of Fort Worth, Tarrant County Texas as recorded in volume 388-D page 179 being 25 feet wide and approxunately 903 63 feet long contauvng 0 732 acres, more or less and as more specifically described in Exhibit `1 `2" and `3 attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That existing utility easements shall be retained by the City until such tune all utilities located in that easement are relocated at the owner's expense. SECTION 3. That the fee to the land ui the above-described street rights-of--way ~s released and shall revert to the adjacent owner as provided by law SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Spencer Survey Abstract No 1395 City of Fort Worth, said 0 732 acres of land being a portion of a called 25 feet wide roadway as shown on the plat of Draughon Heights Addition, an addition to said city according to the plat filed in Volume 388/D Page 179 Plat Records, Tan: ant County Texas; said 0 732 acres of land being more particularly described by metes and bounds as follows. DISCUSSION Donahue Engineering acting on behalf of Chris McBee of Fort Worth, Texas, has requested vacation of the above referenced portion of an unnamed street in order to incorporate it into his adjacent property The Engineering Department, Real Property Services Division, states that the administrative fee of $100 00 has been received Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on July 27 2005 An acceptable final plat has been received. This request is located in COUNCIL DISTRICT 4 .FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
