( V / (M&C C-18135) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Dunaway Associates, Inc . , (Engineer) made and entered into City Secretary Contract No. 24120 (the Contract) which was approved on the lith day of August, 1998 ; and WHEREAS, the Contract involves engineering services for the following project : Preparation of construction plans and right of way plats for Basswood Boulevard from its western terminus to IH-35W. WHEREAS, it has become necessary to execute Amendment No . 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract : 1 . Article I , of the Contract is amended to include the additional engineering services specified in M&C C-18135 adopted, by the City Council on the 18" day of July, 2000 , copy of which is attached hereto and incorporated herein, and further specified in the attached letter dated June 14 , 2000 . The cost to City for the additional services to be performed by Engineer total $36 , 740 . 2 . Article II , of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $51, 395 . K'411 Aff 3 . All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect . FOR BASSWOOD BOULEVARD FROM WEST OF NORTH RIVERSIDE DRIVE TO IH-35W RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City Secretary Contract (No. 24120) with Dunaway Associates, Inc. to provide additional design services for the subject project for a lump sum fee of $36,740.00. DISCUSSION: An engineering services agreement with Dunaway Associates, Inc. was executed on August 11, 1998 City Secretary Contract (No. 24120) for the preparation of construction plans and right-of-way plats for Basswood Boulevard from west of North Riverside Drive to IH-35W for a lump sum fee of$14,655.00. On October 12, 1999 (M&C C-17683), the City Council authorized the City Manager to execute a construction contract with Orval Hall Excavating Company in the amount of $2,236,387.22 for construction of Basswood Boulevard from west of North Riverside Drive to IH-35W. The construction of Basswood Boulevard is now complete and will be open to traffic in August, 2000, after the Texas Department of Transportation (TxDOT) completes the connection of Basswood Boulevard to the northbound frontage road of IH-35W. Dunaway Associates, Inc. performed additional work that was not included in the original scope of work. The additional work items that Dunaway Associates, Inc. performed include: 1. Preparation of two Conditional Letter of Map Revision (C.L.O.M.R.) submissions to the Federal Emergency Management Agency; and 2. Channel realignment study; and 3. Utility study for water and sewer sizing and capacity; and 4. Attended meetings and prepared exhibits for adjacent property owners along Basswood Boulevard; and 5. Revised intersection plans to add turn lanes at Sandshell Drive and Old Denton Road; and 6. Prepared additional easements for sewer line and upstream channel; and 7. Revised plans for utility design (water and sewer); and 8. Revised plans to change pavement width and thickness to connect with TxDOT improvements at IH-35W; and 9. Staff considers the contract amendment of $36,740.00 to be fair and reasonable for the additional design services performed by Dunaway Associates, Inc. Compliance with the City's M/WBE Ordinance as it relates to amendments, change orders or extra work which exceeds 10% of the original amount has been achieved. Dunaway Associates, Inc. has committed to 11% M/WBE participation on this Contract Amendment No. 1. The original fee of $14,655.00 was below the required $25,000.00 threshold, therefore no M/WBE goal was established on the initial contract. This project is located in COUNCIL DISTRICT 4, Mapsco 35Q.
