AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $42,862 FROM
AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING
AGREEMENT WITH EJES INCORPORATED FOR PAVEMENT RECONSTRUCTION
AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON WESLEYAN DRIVE
SOUTH (BIDEKER AVENUE TO STRONG AVENUE TO EAST BERRY STREET) AND
STRONG AVENUE (MITCHELL BOULEVARD TO MARTIN LUTHER KING FREEWAY);
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING
ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 and
in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in
the Water Capital Project Fund in the amount of $42,862 from available funds for the purpose of funding
an Engineering Agreement with EJES Incorporated for pavement reconstruction and water and sanitary
sewer main replacement on Wesleyan Drive South (Bideker Avenue to Strong Avenue from Strong
Avenue to East Berry Street) and Strong Avenue (Mitchell Boulevard to Martin Luther King Freeway)
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

RECOMMENDATION
It is recommended that the City Council:
1 Authorize the transfer of $46 862.00 from the Water & Sewer Operating Fund to the Water Capital
Project Fund;
2. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Water
Capital Project Fund in the amount of $42,862.00• and
3 Authorize the City Manager to execute an engineering agreement with EJES Incorporated in the
amount of $94 940 00 for pavement reconstruction and water main replacement on Wesleyan Drive South
(Bideker Avenue to Strong Avenue from Strong Avenue to East Berry Street) and Strong Avenue (Mitchell
Boulevard to Martin Luther King Freeway)
DISCUSSION
The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction and the Water
Capital Project Fund includes funds for water main replacement on Wesleyan Drive South (Bideker Avenue
to Strong Avenue) (Strong Avenue to East Berry Street) and Strong Avenue (Mitchell Boulevard to MLK
Freeway)
This project consists of the preparation of plans and specifications for pavement reconstruction and water
main replacement on the above-identified streets.
EJES Incorporated proposes to perform the necessary design work for a lump sum fee of $94 940 00 City
staff considers this fee to be fair and reasonable for the scope of services proposed
In addition to the contract amount, $10,843.52 (water $3 696 00• and streets: $7 147.52) is required for
project management by the Engineering Department.
EJES Incorporated is in compliance with the City's M/WBE Ordinance by committing to 19% MMBE
participation. The City's goal on the project is 17%

The Finance Director certifies that upon approval and completion of recommendation 1 and the adoption of
