AN ORDINANCE FINDING THAT CONDITIONS HAVE MATERIALLY
CHANGED SO THAT THE PROJECT SCOPE FOR THE RECONSTRUCTION
OF NORTH TARRANT PARKWAY FROM RAINY LAKE DRIVE TO US 377 AS
INCLUDED IN THE 2004 CAPITAL IMPROVEMENT PROGRAM HAS
INCREASED TO INCLUDE THE RECONSTRUCTION OF THE EXISTING
SOUTH LANES AUTHORIZING THE 2004 CAPITAL IMPROVMENT
PROGRAM FUNDS DESIGNATED FbR NORTH TARRANT PARKWAY BE
USED TO INCLUDE THE INCREASED PROJECT SCOPE PROVIDING THAT
THIS ORDINANCE IS CUMULATIVE PROVIDING A SEVERABILITY
CLAUSE AND PROVIDING AN EFFECTIVE DATE.
WHEREAS on February 7 2004 the citizens of the City of Fort Worth
approved the 2004 Capital Improvement Program, and
WHEREAS the 2004 Capital Improvement Program included the project scope
for the reconstruction of North Tarrant Parkway between Rainy Lake Drive to US 377
and
WHEREAS Fort Worth staff has reevaluated North Tarrant Parkway and has
determined that increasing the project scope to include the reconstruction of the existing
south lanes within the limits of the project would be necessary and wise and
WHEREAS, staff recommends the 2004 Capital Improvement Program funds
designated for the reconstruction of North Tarrant Parkway be used to include the
increased project scope
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH.
SECTION 1
That the Crty Council finds that conditions have materially changed so that the
reconstruction of North Tarrant Parkway from Ramey Lake Drive to US 377 as included

m the 2004 Capital Improvement Program has increased m scope to include
reconstruction of the existing south lanes for length of the project.
SECTION 2.
The City Council hereby authorizes the use of 2004 Capital Improvement
Program funds designated for North Tarrant Parkway from Rainy Lake Drive to US 377
to include the increased scope of the reconstruction of the existing south lanes.
SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are m direct conflict with the provisions of such ordinances and such
Code, m which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECITON 4
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section
SECTION 5.
This ordinance shall be in full force and effect upon adoption.

Rainy Lake Drive to US 377 and Adopt Ordinance
RECOMMENDATION
It is recommended that the City Council.
for Construction of North Tarrant Parkway from
1) Adopt the attached ordinance finding that a material change has occurred such that the scope of work
has increased on the 2004 Capital Improvement Program street reconstruction project, North Tarrant
Parkway from Rainy Lake Drive to US 377 to include reconstruction of the existing south lanes for the
length of the project;
2) Authorize an estimated increase of $1 522,200 in the City's funding participation for construction of
North Tarrant Parkway from Rainy Lake Drive to US 377 for change orders for reconstruction of existing
south lanes and other modifications associated with the project;
3) Authorize corresponding payment to the Texas Department of Transportation for the change orders.
DISCUSSION
Texas Department of Transportation (TxDOT) entered into a contract with Austin Bridge & Road L.P for
construction of the north half of North Tarrant Parkway from Rainy Lake to US 377 The project is included
in the 2004 Capital Improvement Program (CIP) with an allocation of $6 700 000 00 and on June 29
2004 City Council authorized the City's cost participation in the amount of $1 305 727 00
The original project scope did not include reconstruction of the existing south lanes. However the existing
pavement for the south half of North Tarrant Parkway has deteriorated to poor condition Therefore, it is
recommended that the south lanes be reconstructed with six inches of cement stabilized base and six
inches of asphalt pavement, so that when the total four-lane divided arterial is completed in 2006 both the
north and south pavements are of comparable quality and capable of serving the projected traffic for a
reasonable design life.
The Federal funding limit has already been reached and City funding would be used for the change
order There is adequate funding in the 2004 CIP North Tarrant Parkway project budget to pay for this
change order TxDOT and City staff consider the costs to be fair and reasonable. This reconstruction
would have to be done eventually To do the work as a change order to the ongoing contract will avoid
additional mobilization and traffic control costs. Disruption wil! be minimized because the additional work
will be coordinated with the ongoing construction
The proposed work falls within the project limits set in the 2004 CIP and the corresponding description in
the CIP addresses reconstruction of the south lanes from Beach Street to Park Vista Blvd approximately

1 15 miles The proposed change would complete the reconstruction for the length of the project,
approximately 2.25 miles.
Given the poor condition of the existing pavement and that this section is within the original boundaries of
the project, staff considers this to be a reasonable and needed change Therefore staff believes that
approval of this change order is an appropriate exception to the recently adopted Restricted Residual
Policy for Surplus Bond Funds.
There are other pending changes associated with the ongoing construction project. They include the
addition of median openings and left turn lanes at Western Meadows Drive and Arcadia Park Drive
requested by the community additional excavation storm drain and driveways required by new
development in the area, median irrigation sleeves requested by PID No 6 and revisions at Park Vista
Drive
If approved 2004 CIP funds designated for the construction of North Tarrant Parkway from Rainy Lake
Drive to US 377 will be paid to TxDOT for the following change order items

HISTORY
On October 8 1996 (M8~C C-15688) the City Counci{ authorized the execution of a Surface Transportation
Program Metropolitan Mobility (STP-MM) agreement with the TxDOT for construction of North Tarrant
Parkway from IH-35W to US 377 City funds in the amount of $593 750 00 were approved from the
Special Assessment Paving Fund with Federal funding in the amount of $2,375 000 00
On June 29 2004 (M8~C G-14406) the City Council authorized the execution of an amendment to the
Funding Agreement to split the project into two sections. (1) from IH-35W to Rainy Lake Drive and (2) from
Rainy Lake Drive to US 377 Federal funding for the subject Section #2 from Rainy Lake to US 377 was
set at $5 572 086 00 plus 80% of right-of-way costs.
On October 26 2004 the City paid TxDOT $1 355 727 04 for the City's estimated share of construction
costs for Section #2.
This project is located in COUNCIL DISTRICTS 2 and 4 Mapsco 35H-36H

The Finance Director certifies that funds are available in the current capital budget, as appropriated of the
Street Improvements Fund.
