AN ORDINANCE REVISING AND AMENDING ORDINANCE NUMBER 11543, ESTABLISHING THE COMMUNITY DEVELOPMENT COUNCIL FOR PURPOSES OF ADVISING THE FORT WORTH CITY COUNCIL ON PROJECT PRIORITIES FUNDED BY GRANTS ENUMERATED HEREIN ESTABLISHING THE DUTIES AND MEMBERSHIP OF THE COMMUNITY DEVELOPMENT COUNCIL, PROVIDING FOR STAFFING FOR THE COMMUNITY DEVELOPMENT COUNCIL, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. Be it ordained by the City Council of the City of Fort Worth, Texas that: SECTION 1 City of Fort Worth Ordinance No 11543 (1994), on file in the Fort Worth City Secretary's office is hereby amended and after said amendment, shall read as follows A citizen s advisory board to be known as the Community Development Council is hereby established for the purposes of advising the City Council on setting priorities for projects funded through the following Grant Programs of the United States Department of Housing and Urban Development: Community Development Block Grant program Emergency Shelter Grant program Housing Opportunities for Persons with AIDS Grant program and complying with all requirements imposed by the United States government regarding the above listed grant programs. SECTION 2. ,~.~ Subject to the provisions of Chapter 2 Administration Article III `Boards and Commissions" Division 3 of the Code of the City of Fort Worth, Texas (1986), as amended, the Community Development Council shall be comprised of nine (9) membership places. The City Council shall appoint one citizen of the City of Fort Worth to serve m each place. Members appointed to odd numbered places shall have terms which expire m odd numbered years, and members appointed to even numbered places shall have terms which expire in even numbered years. Members shall serve two-year terms, and no member shall serve more than three consecurive two-year terms. Members shall serve without compensation and may be removed at any rime by the City Council. SECTION 3 Staff support of the Community Development Council will be as assigned by the City Manager SECTION 4 The Community Development Council shall review hold public hearings on and make recommendarions to the City Council concerning proposals for funding with Grant monies from the Grant programs specified above. Such recommendations shall be advisory only and not be binding on the City Council. SECTION 5 This ordinance shall be cumulative of all provisions of ordinances and of the code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. ,~`,' a SECTION 6 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this orchnance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence paragraph or sections. SECTION 7 This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY Assistant City Attorney Date. Adopted ~ ~~ ~' Cify of Fort Worth, Texas Mayor and Council Commun~cat~on COUNCIL ACTION Approved on 6/22/2004 Ordinance No 16009 DATE Tuesday June 22 2004 LOG NAME 02CDC REFERENCE NO *G-14397 SUBJECT Adoption of an Ordinance Amending the Community Development Council Policies and Procedures RECOMMENDATION It is recommended that the City Council adopt the attached revision of the Community Development Council Policies and Procedures Ordinance DISCUSSION The Community Development Council (CDC) is a nine member comittee of citizens appointed by the City Council which hears requests and issues concerning the Community Development Block Grant (CDBG) funds, received by the City of Fort Worth from the U S Department of Housing and Urban Development .(HUD) The last update of the CDC's Ordinance occurred on April 12, 1994 1t was under this amendment that the CDC's scope was narrowed to the review of the CDBG grant process. The change in the CDC's role was to reflect the organizational restructuring at the time Since 1994 the City of Fort Worth has received the Emergency Shelter Grant (ESG) and the Housing Opportunities of Persons with HIV/AIDS Grant (HOPWA) The current ordinance allows the CDC to only review the CDBG grant process. Under this amendment, the CDC will continue to review the CDBG grant process and include the ESG and HOPWA grant processes. FISCAL.
