HomeMy WebLinkAboutOrdinance 15911ORDINANCE NO. ~ ~ AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH AMENDING SECTION 4.705 TO REQUIRE TWO PARKING SPACES BEHIND THE FRONT BUILDING LINE FOR ONE-FAMILY DWELLINGS IN THE A-5" ONE-FAMILY DISTRICT AMENDING SECTION 6.201 TO REVISE PARKING REQUIREMENTS FOR MULTIFAMLY DWELLINGS, PLACES OF WORSHIP SCHOOLS, COMMERCIAL BUSINESSES, OFFICES, RESTAURANTS, WALKUP BUSINESSES, THEATERS AND PLACES FOR PUBLIC ASSEMBLY PROVIDING THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE WHEREAS, in response to requests from the Commercial Corndors Task Force, the Crty Plan Commission, and City Council members, the City Manager appointed a Development Standards Task Force to conduct a review of development standards and procedures as they affect central city revrtahzation and other Crty Council strategic goals, WHEREAS, the Development Standards Task Force is comprised of 42 members, consisting of public officials, representatives from the development commumty and neighborhood and business leaders; WHEREAS, the Development Standards Task Force formed four comrmttees to focus on four categories of development issues. construction codes, subdivision and street development standards, zomng regulations, and process unprovements; WHEREAS, after studying the zoning ordinance and conducting numerous meetings and public forums the zoning subcomrmttee of the Development Standards Task Force has recommended amendments to the zoning ordinance; WHEREAS, the proposed amendments reduce and sunphfy off-street parking requirements, allow townhouses, zero lot hne residential dwellings, and cluster housing to be constructed m the `C" and `D" multifamily distracts at the same density as apartments; update site plan standazds; allow pravate parks and pnvate recreation facilities in all single-family distracts, delete obsolete mdustnal uses from the Nonresidential Distract Use Table; allow trees planted m the pazkway to be credited towazd landscape requirements, establish development standards for single- family detached dwelling amts on 3,300 square foot lots m the `Rl Zero Lot Line/Cluster distract; and increase the maxunum lot coverage permitted in the A 5" One-Family Distract; WHEREAS, in order to simplify consideration of the proposed amendments, each issue has bee included m a sepazate ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Section 4 705 `One Family (A 5) Distract" Subsection D `Other Development Standards" is amended to require one-family dwellings to have two parking spaces behind the front building hne, as follows. D. Other Development Standards 2. Parking. Two spaces per dwelling amt, located behind the front building line. For nonresidential uses, see Chapter 6, Article 2. SECTION 2. Section 6.201 `Off-Street Pazkmg Requirements, Subsection B, `Required On-Street Pazking is amended to establish maximum permitted pazking spaces equal to 125% of the minimum requirements, change the parking requirements for multifamily dwellings, places of 2 worship, schools, commercial businesses, offices, restaurants and walkup businesses; and recalculate the method for determining parking requirements for medical clinics, hotels, pnvate clubs and lounges, theaters and mdustnal buildings based on a ratio to 1 000 square feet of gross floor area, as follows. 6.201 Off-Street Parking Requirements B. Required Off-Street Parking The number of parking spaces provided m accordance with the table set out below shall not exceed 125% of the minimum parking requirement. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflycting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 6. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 7 The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code. 5 SECTION 8.
