HomeMy WebLinkAboutOrdinance 16113r~" ~~ll~ ORDINANCE NO AN ORDINANCE VACATING AND EXTINGUISHING PARKDALE AVENUE RIGHT-OF WAY FROM THE NORTH BOUNDARY OF LOT 1 BLOCK 1 POLYTECHNIC HIGH SCHOOL ADDITION TO THE SOUTH RIGHT-OF WAY LINE OF VICKERY BOULEVARD, AND TWO ALLEYS LOCATED IN BLOCK A OF THE OCIE SPEER ADDITION FORT WORTH, TEXAS PROVIDING FOR REVERSION OF FEE IN SAID LAND• THE RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT the following street and alleys described below 1 Parkdale Avenue Right-of Way from the North boundary of Lot 1 Block 1 Polytechnic High School Addition to the South Right-of Way line of Vickery Boulevard, being approximately 50 feet wide and 682 feet long and containing 34 107 5 square feet; 2 Two alleys located in Block A of the Ocie Speer Addition, Fort Worth Tarrant County Texas, more specifically being a 16 7 foot wide by 502 foot long alley containing 8,363.5 square feet located between Lots 6 through 15 and Lots 21 through 30 and a 20-foot wide by 267.3-foot long alley containing 5,357 9 square feet running between Lots 15 and 21 and Lots 16 through 20 from Beach Street to Parkdale Avenue Right-of Way and as more specifically described m Attachment A attached hereto and incorporated herein, by reference be and the same are vacated and extinguished. SECTION 2. That the fee to the land m the above-described vacated street portion and alleys is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located m that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances m conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. DISCUSSION LandCon Inc. acting on behalf of Fort Worth ISD has requested vacation of the above referenced right=of way in order to include the property in a replat to accommodate the planned athletic complex expansion.The alleys/street to be vacated shall be retained as a utility easement for any existing utilities (unless other satisfactory arrangements are made including relocation at owners expense) The Engineering Department, Real Property Services Division states that the right-of-way and alley vacation is valued at $2,948 15 however as matter of public interest, the purchase fee is $1 00' the applicant has paid this in full The City Plan Commission recommended approval of this vacation request at its meeting on August 27th 2003 Transportation and Public Works has determined that the vacation of this right-of-way would not have any detrimental effect to the city An acceptable replat has been received This request is located in COUNCIL DISTRICT 8 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
