I ~ I " AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH (1986), BY AMENDING THE DOWNTOWN URBAN DESIGN STANDARDS REFERRED TO IN SECTION 2.104 AND SECTION 4.1200 OF THE ZONING ORDINANCE BY AMENDING SECTION 4. BUILDING EDGE, SPECIAL VIEW AREAS, PARAGRAPH 4 LANCASTER CORRIDOR ZONE, PAGE 4-10 OF THE DOWNTOWN FORT WORTH URBAN DESIGN STANDARDS, DECEMBER 2001, TO ESTABLISH HEIGHT RESTRICTIONS AND REGULATIONS FOR NEW CONSTRUCTION IN THE LANCASTER CORRIDOR, PROVIDING THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS it is the purpose of the Lancaster Comdor Distract to provide a specific zone v~nthin the central business distract that emphasizes a pedestraan oraentation and respects the lustorac fabrac of existing buildings; providing restractions on height and regulations for new construction; and such uses accessory thereto, WHEREAS development in the Lancaster Comdor distract should facilitate the creation of a pedestrian-oraented, mixed-use growth center as envisioned in the Crty's Comprehensive Plan; WHEREAS existing language in the Downtown Urban Design Standards refers to future developments which have since taken place (i.e., the relocation of I 30); WHEREAS the proposed changes fulfill the recommendation referred to in the Downtown Urban Design Standards to establish appropriate building height, setback and related design guidelines; WHEREAS, Sections 2 through 5 of the Downtown Urban Design Standards were approved by the City Council and included in the zomng ordinance by reference. WHEREAS, Subsection D `Downtown Urban Design Standazds Adopted" of Section 4 1200 "Urban Design District-Downtown requires any amendments to Sections 2 through 5 of the Downtown Urban Design Standazds to be considered by the Zoning Commission and approved by the City Council in accordance with the procedure set out m Article 5 Chapter 3 WHEREAS, it is advisable to amend Section 4 Building Edge, Special View Areas, paragraph 4 Lancaster Corndor Zone, page 4-10 of the Downtown .Fort Worth Urban Design Standazds, December 2001 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. Section 4 Building Edge, Special View Areas, paragraph 4 Lancaster Comdor Zone, page 4-10 of the Downtown Fort Worth Urban Design Standazds, December 2001 is amended to promote a mix of uses in a pedestnan-onented environment that is compatible with existing histonc structures as follows. 4 Lancaster Comdor Zone To encourage pedestnan activity along Lancaster Avenue, new development along this street should accommodate retail, office, institutional, or other active uses at the street level. Surface pazking lots and front yard pazking and loading aze discouraged. Any structured pazlcing should be designed so as to locate vehicular entrances and exits away from Lancaster Avenue. New additions to existing buildings and new construction shall be differentiated from the histonc buildings on Lancaster Avenue and shall be compatible with the massing, size, scale, and architectural features to protect the historic integnty of these 2 buildings and their environment. New additions and new construction shall be undertaken in such a manner that if removed m the future, the essential form and mtegnty of the lustonc buildings and their environment would be unimpaired. SECTION 2. Thrs ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent junsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. 3 SECTION 5. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this orcnance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code. SECTION 7 This ordinance shall take effect upon adoption and publication as required by law APPROVED AS TO FORM AND LEGALITY By ~~ .9~~ ~.
