AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY
OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED,
CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT
WORTH, AMENDING SECTION 4.803 TO ADD INDOOR RECREATION
AS A PERMITTED USE AND TO ALLOW HEALTH CLUBS AS A
PERMITTED USE UNDER THE `FR" HEADING IN THE
NONRESIDENTIAL DISTRICT USE TABLE, AMENDING SECTION 9.01
TO ADD A DEFINITION OF `INDOOR RECREATION"• PROVIDING
THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A
SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE,
PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, over the last several years, numerous questions have been raised regazding
the appropraate zoning distract for certain indoor recreational type activities,
WHEREAS, the Development Department staff has determined that formalized recreation
facilities such as bowling alleys and softball facilities aze consistent with other types of similaz uses
such as indoor basketball, hockey roller/ice skating ranks, soccer, and batting practice areas,
WHEREAS, these uses are similaz m size, attendance and traffic generation and should be
considered consistent uses and should be allowed m the `FR Restncted Commercial Distract:
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS.
SECTION 1
Section 4.803 "Nonresidential Distract Use Table `Entertainment and Eating is amended
to allow indoor recreation as a permitted use m the `FR Restricted Commercial District, by
inserting `Indoor Recreation after `Health or Recreation Club and inserting a `P" in the `FR
column and a diamond in the `PD" column.
SECTION 2.
Section 4.803 "Nonresidential Distract Use Table" `Entertauunent and Eating is
amended to allow health clubs as a permitted use m the `FR Restricted Commercial Distracts,
by inserting a `P" in the `FR column.
SECTION 3.
Section 9 101 `Defined Terms" is amended to add a definition of `indoor recreation
as follows.
INDOOR RECREATION A pravately established and operated facility that provides
indoor recreational opportunities for a fee, including, but not limited to, roller ice
skating, and hockey ranks, batting cages, gymnasium or indoor arena, basketball,
handball, and tennis courts, but not for any use involving animals.
SECTION 4.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are m direct conflict with the provisions of such ordinances and such Code, m which
event conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the Crty Council that the sections, paragraphs,
sentences, clauses and phrases of this orchnance aze severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent ~urasdiction, such unconstiturionahty shall not affect any of the
remasning phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 6.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply
with or who resists the enforcement of any of the provisions of this ordinance shall be fined not
more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists
shall constitute a separate offense.
SECTION 7
All rights and remedies of the Crty of Fort Worth, Texas, are expressly saved as to any and
all violations of the provisions of Ordinance No 13896 which have accrued at the time of the
effective date of this ordinance and, as to such accrued violations and all pending litigation, both
civil and crunmal, whether pending m court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 8.
The City Secretary of the Crty of Fort Worth, Texas, is hereby directed to publish the
caption, penalty clause and effective date of this ordnance for two (2) days in the official
newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local
Government Code.
SECTION 9
This ordinance shall take effect upon adoption and publication as required by law
