AN ORDINANCE INCREASING APPROPRIATIONS IN THE SOLID WASTE
FUND IN THE AMOUNT OF $1,399,133 AND DECREASING THE
UNRESERVED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE
PURPOSE OF FUNDING A CONTRACT WITH WASTE MANAGEMENT OF
TEXAS, INC. FOR EMERGENCY COLLECTION SERVICES AS A RESULT OF
THE JUNE 1, 2004 STORM DEBRIS; MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-
2004 in the Budget of the City Manager, there shall also be increased appropriations in the Solid
Waste Fund in the amount of $1,399,133 and decreasing the unreserved retained earnings in the
same amount for the purpose of funding a contract with. Waste Management of Texas, Inc. for
emergency collection services as a result of the June 1, 2004 storm debris.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the. remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15636 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Appropriation Ordinance and Award of Contract to Waste Management of Texas, Inc. for
Emergency Collections Services of Storm Debris
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing appropriations in the Solid Waste Fund by
$1,399,133, and decreasing unreserved retained earnings by the same amount; and
2. Approve the execution of contract with Waste Management of Texas, Inc. for emergency .collection
services as a result of the June 1,2004 storm debris for a total cost not to exceed $1,399,133.
DISCUSSION:
The week of June 1, 2004, severe storms swept through Fort Worth causing widespread damage to trees
and vegetation. Immediately following the storm, City Staff assessed the hardest hit areas and determined
normal solid waste collection services would need to be augmented with additional manpower in order. to
clear the massive debris caused by the storm across the City.
Consultation and negotiation with Waste Management of Texas, Inc., the City's current solid waste
collection contractor, resulted in the following plan to mitigate the debris from the storm damage:
Waste Management agreed to utilize storm chaser equipment to "sweep" the heaviest hit sections of the
City to collect the storm debris brought curbside; the "sweeps" began on June 7, 2004. The cost of this
service is $110 per driver hour, plus an administrative fee of $5 per hour (a total of $115 per hour). The
estimated cost of these services is $1,230,213.
For $1.03 per home, Waste Management agreed to collect all extra bags of garbage (outside of the carts)
for the week of June 7 (one week) and agreed to collect small piles of unbundled limbs at .the curbside with
yard wastes for four (4) consecutive weeks beginning June 7, 2004. The cost of this service is based on
the estimated June house count of 164,000 and is estimated to cost $168,920.
Section 252.022 of the Local Government Code exempts from competitive bidding procurements made
necessary. as a result of a public calamity. The Department of Law has. reviewed the expenditure and has
approved it as an emergency purchase.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of recommendation No. 1, and adoption of the attached
appropriation ordinance, funds will be available in the current operating budget as appropriated, of the Solid
Waste Fund. The unrestricted cash balance of the Solid Waste Fund will be $11,003,517; however, current
unpaid invoices totaling $ 5,206,915 will further reduce this amount. In addition, revenues are estimated to
end the year $1,577,530 under budget and expenditures are on track to be $1,058,412 over budgeted
appropriations.
