ORDINANCE NO.
AN ORDINANCE VACATING AND EXTINGUISHING A PORTION
OF WEST CANTEY STREET FROM A POINT AT THE WEST LINE
OF THE ALLEY OF BLOCK 23 TO THE WEST LINE OF BLOCK 22,
UNIVERSITY PLACE ADDITION, SAID RIGHT-OF-WAY BEING
ADJACENT TO LOT 1R, BLOCK 1, TCU•ADDITION, LOT 8, BLOCK
22, AND LOT 9, BLOCK 23 OF THE .UNIVERSITY PLACE
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS, AND BEING APPROXIMATELY 386 FT LONG AND 70 FT
WIDE AND CONTAINING 27,024 SQUARE FEET, MORE OR LESS;
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of West Cantey Street from a point at the west line of the alley of
Block 23 to the west line of Block 22, University Place Addition, said right-of--way being
adjacent to Lot 1R, Block 1, TCU Addition, Lot 8, Block 22, and Lot 9, Block 23 of the
University Place Addition to the City of Fort Worth, Tarrant County, Texas, and being
approximately 386 ft long and 70 ft wide and containing 27,024 square feet, more or less;
and as more specifically described in Exhibit "A" attached hereto and incorporated herein
by reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street and alley rights-of--way is
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.

That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

VACATION OF WEST CANTEY STREET.
FROM COLONIAL PARK ADDITION
EAST 386.0 FEET
Beginning at a "Y" cut in concrete found in place at the northwest corner of Lot
1R, Block 1 of TCU Addition an addition to the City of-Fort Worth as Recorded in
Cabinet A, Slide 4481 of the Plat Records of Tarrant County, said "Y" being in the
south .right-o~nray line of West Cantey Street and the east line of Colonial Park an
addition to the City of Fort Worth as Recorded in Volume 388-B, Page 208 of the
Deed Records of Tarrant County (D.R.T.C.);
Thence, North 0°13'19" West with the east line of said Colonial Park Addn. a
distance of 70.0 feet to a point in the north Right-of--Way line of West Cantey Street
and in the, south line of a tract of land conveyed to Texas Christian University
(TCU tract) by deed as recorded In Volume 1974, Page 305 of the D.R.T.C.;
Thence, South 89°37'24" East, a distance of 385.91 feet to the southeast corner of
said TCU tract;.
Thence, South 0°28'13" East, a distance of 70.0 feet to a 518" iron pin set in the
south Right-of way line of West Cantey street and the north line of said Lot 1 R
TCU Addition;
Thence, North 89°37'24" West along the south right-ofway line of West Cantey
Street and the north line of said Lot 1R, a distance of 386.21 feet to the,Point of "
Beginning and containing 0.62 acres of land.

It is recommended that the City Council adopt the attached ordinance vacating a portion of West Cantey
Street from a point at the west line of the alley of Block 23 to the west line of Block 22, University Place
Addition, said right-of-way being adjacent to Lot 1 R, Block 1, TCU Addition, Lot 8, Block 22 and Lot 9, Block
23 of the University Place Addition to the City of Fort Worth, Tarrant County, Texas and being
approximately 386 ft. long and 70 ft. wide and containing 27,024 square feet, more or less.
DISCUSSION:
J.B. Davis, acting on behalf of Larry Garrison for Texas Christian University, has requested vacation of the
above referenced portion of West Cantey Street in order to include the property. within a replat for
development. .
The~Engineering Department, Real Property Services Division, states that Real Estate Information Services
and Alamo Title Company researched this portion of West Cantey Street for ownership and found no--
evidence of any city acquisitions or dedication to the public. Therefore no purchase fee will be required for
quitclaim purposes.
The City Plan Commission recommended approval of this vacation request at its meeting on June 23rd,
2004 subject to the retention of necessary easements for public utilities. No permanent structures shall be
constructed over any existing water, sanitary sewer or public utility easement. An acceptable re-plat has
been received and reviewed for compliance with the City's regulations.
This request is located in COUNCIL DISTRICT 9.
