HomeMy WebLinkAboutOrdinance 15924ORDINANCE NO. 1 ~ l AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, AMENDING SECTION 6.202 CONCERNING PARKING LOT DESIGN STANDARDS, PROVIDING THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE WHEREAS, m response to requests from the Commercial Comdors Task Force, the City Plan Commission, and City Council members, the City Manager appointed a Development Standards Task Force to conduct a review of development standards and procedures as they affect central city revitalization and other City Council strategic goals; WHEREAS, the Development Standards Task Force is comprised of 42 members, consisting of public officials, representatives from the development community and neighborhood and business leaders; WHEREAS, the Development Standards Task Force formed four comrmttees to focus on four categories of development issues: construction codes, subdivision and street development standards, zomng regulations, and process unprovements; WHEREAS, after stud}nng the zoning ordinance and conducting numerous meetings and public forums the zoning subcommittee of the Development Standards Task Force has recommended amendments to the zomng ordinance; WHEREAS, the proposed amendments reduce and sunphfy off-street parking requirements; allow townhouses, zero lot line residential dwellings, and cluster housing to be constructed in the `C" and `D" multifamily distracts at the same density as apartments; update site plan standards; allow private parks and private recreation facilities in all single-family districts; delete obsolete industrial uses from the Nonresidential District Use Table; allow trees planted m the parkway to be credited toward landscape requirements; establish development standards for smgle- family detached dwelling units on 3,300 square foot lots m the `R1 Zero Lot Line/Cluster district; and repeal maximum lot coverage regulations for A 2.5" through A 5" One-Family and `B" Two-Family Distracts so that lot coverage will be lunited only by setback requirements; WHEREAS, m order to simplify consideration of the proposed amendments, each issue has been included m a separate ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. Section 6.202, `Parking Lot Design Standards" Subsection A, `Space Size" is amended to allow parking spaces adjacent to landscape areas to be reduced m length from 18 feet to 16 feet and to project into the landscape area, provided the parking spaces are separated from the landscape area by curbing or approved wheel stops, as follows. 6.202 Parking Lot Design Standards A. Space Size The following minimum standards shall apply to the width and length of parking spaces. *Parking spaces adjacent to landscape areas may project into the landscape area and be reduced to 16 feet in length when separated from the landscape area by curbing or approved wheel stops. 2 SECTION 2. Section 6.202, `Parking Lot Design Standards" Subsection D `Maneuvering Space, is amended to recognize that public right-of way may be used for maneuvering and parking in connection with approved on-street parking and to recognize that parallel parking spaces may be substituted for off-street parking requirements as provided m regulations governing MU-1 and MU 2 Mixed-Use Districts, as follows. 6.202 Parking Lot Design Standards D. Maneuvering Space 1 Maneuvering space shall be located completely off the right-of way of a public street, place or court, except for on-street parking approved by the Traffic Engineer 2. Parking areas that would require the use of public right-of--way for maneuvering shall not be acceptable as required off-street parking spaces other than for one and two-family dwellings, except for on-street parking approved by the Traffic Engineer 3 Parking parallel to the curb on a public street shall not be substituted for off street parking requirements, except as provided for in an MU-1 or MU-2 Mixed-Use District. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or 3 decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Crty Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separ;~te offense. SECTION 6. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 13896 which have accrued at the tune of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 7 The City Secretary of the City of Fort Worth, Texas, is hereby du'ected to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code. 4 SECTION 8.
