' ~ (O~ ~' AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, AMEND SECTION 6.101 `YARDS" TO ADD SETBACK REQUIREMENTS FOR ZERO LOT LINE/CLUSTER ("Rl') AND TOWNHOUSE/CLUSTER ("R2 ') DISTRICTS LOCATED ACROSS FROM ONE-FAMILY TWO- FAMILY AND MULTIFAMILY DISTRICTS, AMENDING THE TABLES IN SUBSECTION C `PROPERTY DEVELOPMENT STANDARDS OF SECTIONS 4.708 AND 4.709 TO ADD A REFERENCE TO SECTION 6.101 FOR ZERO LOT LINE/CLUSTER ("Rl ') AND TOWNHOUSE/CLUSTER ("R2") DISTRICTS, TO AMEND CHAPTER 4, ARTICLE 6, `RESIDENTIAL USE TABLE TO ADD A REFERENCE TO SECTION 6.101 FOR ZERO LOT LINE/CLUSTER ("Rl ') AND TOWNHOUSE/CLUSTER ("R2") DISTRICTS, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING FOR PUBLICATION AND NAMING AN EFFECTIVE DATE. WHEREAS, the current regulations allow for the development ofone-family and two-family dwelling amts on smaller lots areas and zero yards and for the development of row houses, townhouses, and one-family homes clustered around a common access road or cal-de-sac; WHEREAS, the minimum setback requirements for the Zero Lot Line/Cluster ("R1 ') and Townhouse/Cluster ("R2") Distracts are less than for other residential distracts, WHEREAS, it is necessary to provide protection of the block face in established residential neighborhoods where there is a potential for inconsistent setbacks on the same block face; WHEREAS, it is advisable to amend the Zoning Ordinance to require the same setbacks for the Zero Lot Line/Cluster ("Rl ') and Townhouse/Cluster ("RZ") developments when they are located across the street from One-Family Two-Family and Multifamily Distracts; NOW THEREFORE,`BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS AS FOLLOWS SECTION 1 Chapter 6, Article 1 of Ordinance No. 13896, the Zoning Ordinance of the City of Fort Worth, Section 6101 `Yards" is amended by amending Subsection C `Nonresidential Distracts Across the Street from Residential Districts" to include requirements to add setback requirements for Zero Lot Line/Cluster ("R1 ') and Townhouse/Cluster ("R2") Distracts located across from One-Family Two-Family and Multifamily Districts to read as follows. 6 101 Yards C. Zero Lot Lme/Cluster ("R1 ') and Townhouse/Cluster ("R2") Distracts and Nonresidential Distracts Across from Residential Distracts 1 Zero Lot Line/Cluster ("Rl ') and Townhouse/Cluster ("R2") Districts. For Zero Lot Line/Cluster ("R1 ') and Townhouse/Cluster ("R2") Distracts that abut a public or pravate street and that are across the street from aOne-Family Residential or a Multifamily Distract, the front, side and rear setback requirements shall be the same as the setback requirements for the residential or multifamily distract. 2. Nonresidential Districts. Property located in 'FR through 'K distracts that abuts a public or private street and that is across the street from aOne-Family Residential or a Multifamily Distract, the front, side and rear setback requirements shall be the same as the setback requirements for the residential or multifamily distract. 2 3 The setback requirement shall apply to the entire front, side or rear yard and shall not be limited to the portion of the property that is directly across the street from a residential distract. The setback requirement shall extend through the entire block face. SECTION 2. Chapter 4 Article 7 of Ordinance No 13896, the Zoning Ordinance of the City of Fort Worth, `Residential Distracts" is hereby amended to amend the notes table m Subsection C. `Property Development Standards" in Section 4 708 `Zero Lot LinelCluster ("R1 ') District" to read as follows. Notes. * Maybe subject to projected front yard (Section 6 lO1F) May be subject to other front, side and rear yard setback requirements (Section 6 101 C) SECTION 3. Chapter 4 Article 7 of Ordinance Na 13896, the Zomng Ordinance of the City of Fort Worth, `Residential Distracts" is hereby amended to amend the notes table in Subsection C `Property Development Standards" in Section 4 709 `TownhouselCluster ("RZ") Distract" to add a reference to Section 6.101C to read as follows. Notes. May be subject to other front, side and rear yard setback requirements (Section 6.101 C) SECTION 4 Chapter 4 Article 6 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, Section 4 603 `Residential Distract Use Table is amended to add an astensk (P*) to reference to Section 6.1O1C for the columns labeled `Rl and `RZ" Distracts under `Residenrial Living, Household Living for `One family Zero Lot Line Detached" 3 SECTION 5 Chapter 4 Article 6 of Ordinance No 13896, the zoning ordinance of the Crty of Fort Worth, Section 4 603 `Residential Distract Use Table is amended to add an asterisk (P*) to reference to Section 6101C for the column labeled `R2" Distract under `Residential Living, Household Living" for `One-family Attached (townhouse, rowhouse)" SECTION 6. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 7 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Crty Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 8. Any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance 4 shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 9 All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No 3011 Ordinance No 13896 or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and cnmmal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but maybe prosecuted until final disposition by the courts. SECTION 10. That the City Secretary of the City of Fort Worth, Texas is hereby directed to publish this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by V T C.A.
