ORDINANCE NO
AN ORDINANCE ADJUSTING THE TOTAL N$JMBER OF
AUTHORIZED CIVIL SERVICE POSITIONS IN THE POLICE
DEPARTMENT INCREASING AUTHORIZED POSITIONS BY ONE,
PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE
ADOPTION AND IMPLEMENTATION OF THIS ORDINANCE,
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE,
PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN
EFFECTIVE DATE.
BE IT HEREBY KNOWN
WHEREAS the Police Chief has requested the City Council to readjust and
thereafter specify the total number of authorized civil service positions at the police
officer rank in the Police Department into conformity with the proposed changes as set
forth immediately below m order to effect efficient economy of the operations of the
Police Department; and
WHEREAS on October 26 2004 the City Council approved the most recent
ordinance concerning the authorized and budgeted positions for the Police Department.
In that Ordinance, the Council adjusted the Police Department's civil service staffing,
effective October 30 2004 as follows

Corporal/Detective 183

Total 1,337
WHEREAS on November 9 2004 the Crty Council approved a plan to realign
the staff associated with animal cruelty investigation, and
WHEREAS pursuant to Chapter 143 021 (a), Texas Local Government Code, the
City Council may prescribe the authorized number of positions in each classification
(rank) and the correct number of budgeted civil service positions by ordinance
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS
SECTION 1
That, effective upon adoption, the following positions shall be the only civil
service positions m each classification (rank) authorized m the City of Fort Worth Police
Department for the remainder of the fiscal year 2004-2005 or until modified by
subsequent ordinance

Captain 12
Lieutenant 46
Sergeant 131
Corporal/Detective 183
Police Officer 961
Total 1,338
SECTION 2.
The `Mayor and Council Communication memorandum, which is presented
contemporaneously with this ordinance, is hereby expressly incorporated herein by
reference for further clarification and explanation of the purpose and intent of the Council
in their adoption as well as the Department's implementation of this ordinance
SECTION 3
This ordinance shall be cumulative of all provisions of previous ordinances and of
the Code of the City of Fort Worth, Texas (1986), as amended, except where the
provisions of this ordinance are m direct conflict with the provisions of prior civil service
staffing ordinances for the Police Department and such Code, in which event conflicting
provisions of such ordinances and such code provisions are hereby repealed and this
ordinance shall be controlling.
SECTION 4
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation m this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5
This ordinance shall take effect and be in full force and effect from and after its
passage, and it is so ordained.

Adoption of Civil Service Staffing Ordinance Increasing Authorized Strength by One Officer
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance specifying the authorized positions in
the Police Department, increasing the number of authorized positions by one officer
DISCUSSION
On November 9 2004 (M&C G-14575) the City Council approved the realignment of the Animal Cruelty
Investigators program in the Public Health Department. The program was originally comprised of two
positions in the Public Health Department with the mission of investigating animal-related offenses with a
penalty higher than a Class C misdemeanor Since these positions could not be commissioned as peace
officers in the Public Health Department, one of the positions is being moved to the Police Department with
the other continuing coordination in the Public Health Department. Since it is not practical to centralize the
investigation of these types of crimes one additional position is intended to offset the total workload to the
department.
Funds of $50 983 were moved by ordinance from the Public Health Department to the Police Department
to offset the cost of one position In order to continue the phase-out of 24 of 36 field corporal positions an
officer position will be added and an existing corporal/detective position will be moved to an investigative
unit. This M&C will adjust the authorized strength accordingly
The Police Department's authorized strength is 1 337 The addition of this position will result in the
following changes in the authorized strength of the Police Department, effective immediately upon
approval. (See table below )
