SUMMERS, NELDA F HARRIS, CARLA G. KELMAN NANCY A. MAGEE AND EDWARD B. VALVERDE AND APPOINTING MARY S. O'REILLY ANDREW T BRADSHAW AND NANCY E. STRICKLAND AS SUBSTITUTE MUNICIPAL JUDGES FOR A ONE YEAR TERM COMMENCING APRIL 1, 2004 AND ENDING MARCH 31 2005 OR UNTIL A SUCCESSOR IS QUALIFIED AND APPOINTED IN ACCORDANCE WITH STATE LAW PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That Charles F Berger Ann Y Collins, Faye R. Harden, Nemuel E. Pettie, Ronald L. Hemngton, Patricia L. Summers, Nelda F Hams, Carla G Kelman, Nancy A. Magee and Edward B Valverde be reappointed and Mary S O'Reilly Andrew T Bradshaw and Nancy E. Strickland be appointed as substitute Mumcipal Judges for a one year term commencing April 1 2004 and ending March 31 2005 or until a successor is qualified and appointed in accordance with state law SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and Code, m which event such conflicting provisions of such ordinances and Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent Junsdiction, such ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs,and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall take effect upon adoption. Magee and Edward B Valverde as substitute Municipal Judges for aone-year term commencing April 1 2004 and ending March 31 2005 or until a successor is qualified and appointed in accordance with state law and 2. Appointing Mary S O'Reilly Andrew T Bradshaw Judges for aone-year term to commence April 1 2004 qualified and appointed in accordance with state law and Nancy E. Strickland as substitute Municipal and ending March 31 2005 or until a successor is DISCUSSION Chapter 30 Section 30 00008 of the Government Code states that the governing body of the municipality may appoint one or more qualified persons to be available to serve for a Municipal Judge who is temporarily absent due to illness, family death continuing legal or judicial education programs or any other reason The presiding judge shall select one of the. qualified persons appointed by the governing body to~ serve during the absence of a Municipal Judge The substitute judge while serving as a Municipal Judge has all the powers and shall discharge all the duties of a Municipal Judge All of the named persons cited above meet the qualifications prescribed for the Municipal Judge On March 2, 2004 the City Council's Public Safety Committee voted to recommend to the full City Council the above listed persons for reappointment and appointment as substitute Municipal Judges FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that funds are available in the current operating budget, as appropriated of the General Fund TO Fund/Account/Centers FROM Fund/Account/Centers Submitted for City Manager's Office by; Sara Fullenwider (7619) Originating Department Head.
