HomeMy WebLinkAboutOrdinance 15836.~, Ordinance No AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $98,823.50 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN AWARD OF CONTRACT TO MCCLENDON CONSTRUCTION CO INC FOR RECONSTRUCTION OF WIMBERLY STREET (MERRIMAC STREET TO WINGATE STREET) AND ASSOCIATED SANITARY SEWER IMPROVEMENTS; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS' SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2003- 2004 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $98,823.50 from available-funds for the purpose funding an award of contract to McClendon Construction Co Inc. for reconstruction of Wimberly Street (Merrimac Street to Wingate Street) and associated sanitary sewer improvements 15~~ SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this- ordinance shall be cumulative of Ordinance No 15636 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed This ordinance shall take effect upon adoption APPROVED AS TO FORM AND LEGALITY A sistant Attorney SECTION 4 ADOPTED AND EFFECTIVE. SUBJECT Appropriation Ordinance and Award of Contract to McClendon Construction Company Inc. for Reconstruction of Wimberly Street (Merrimac Street to Wingate Street) and Associated Sanitary Sewer Improvements RECOMMENDATION It is recommended that the City Council• 1 Authorize the transfer of $98 823 50 from the Water and Sewer Fund to the Sewer Capital Project Fund and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $98 823 50 from available funds, and 3. Authorize the City Manager to execute a contract with McClendon Construction Company Inc. in the amount of $203 179.25 for reconstruction of Wimberly Street, Contract 30 together with associated .sanitary sewer improvements DISCUSSION On December 19 2000 the City Council adopted a resolution authorizing the issuance of $45 million in Certificates of Obligation to address critical capital projects, including $8 million for the reconstruction of neighborhood streets to supplement the 1998 Capital Improvement Program (CIP) The 1998 CIP included funds for reconstruction of Wimberly Street from Merrimac Street to Wingate Street, Contract 30 The Water Department has determined that the existing sanitary sewer main in this street needs to be replaced prior to street reconstruction. On October 23 2003 bids were received on two alternate types of pavement: Alternate A is 5-inch HMAC (hot mix asphalt concrete) over 6-inch subgrade with .lime stabilization; and Alternate B is 6-inch concrete pavement over 6-inch lime stabilized subgrade. McClendon Construction Company Inc. is in compliance with the City's M/WBE Ordinance by committing to 46% M/WBE participation The City's goal on this project is 16% In addition to the contract amount, $6 876 00 is needed for sanitary sewer line construction inspection and survey Contingency funds are also included to cover change orders for sanitary sewer line improvements ($6 000 00) and pavement and storm drains improvements ($6 000 00) This project is located in COUNCIL DISTRICT 9 Mapsco 62X.
