Ordinance No ~~+U'•J~ °'~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $179 930 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO 30187 WITH FREESE AND NICHOLS, INC FOR AN OPERATIONAL ASSESSMENT AND ALTERNATIVE EVALUATION FOR THE ACTIVE POOL OF THE FORT WORTH WATER GARDENS, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $179 930 from available funds for the purpose of a second amendment to City Secretary Contract No 30187 with Freese and Nichols, Inc. for an operational assessment and alternative evaluation for the active pool of the Fort Worth Water Gardens SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. Authorize .the transfer of $179 930 from the Capital Projects Reserve Fund to the Specially Funded Capital Projects fund 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Project Fund by $179 930' and 4 Authorize the City Manager to execute an amendment to City Secretary Contract No 30187 with Freese and Nichols Inc. (FNI) not to exceed $179 930 for additional services to evaluate and plan the replacement and enhancement of the lighting and electrical systems and plumbing facilities related to pump room #2. DISCUSSION On July 6 2004 in M&C C-20145 the City Council authorized the City Manager to execute an agreement with FNI for the operational assessment and alternative evaluation for the Active Pool of the Fort Worth Water Gardens The first contract amendment provide for preliminary design engineering and architectural analysis to determine modifications that best address the needs to enhance safety improve maintenance preserve the aesthetic, quality and reduce costs. As City staff continued to evaluate the Water Gardens malfunctions have been identified in the electrical system throughout the ,gardens and the mechanical and plumbing systems in pump room #2. FNI has agreed to alter the scope to include the following additions. 1 Evaluation of the electrical and lighting system for the entire Water Garden 2. Evaluation of the plumbing and mechanical systems in pump room #2 and 3 Prepare preliminary engineering solutions and cost estimates for pump room #2. City staff anticipates completion of this additional scope of work by January 2005 and the recommendations will be included in the City Manager's complete report on the Water Gardens. FNI is in compliance with the City's MMBE ordinance by committing to 14% MMBE participation on this Lo~name 80WGRENEW PauP 1 of ~ contract amendment.
