HomeMy WebLinkAboutOrdinance 16141!4 ;:fin ORDINANCE NO / l AN ORDINANCE AMENDING SECTIONS 35-56(g) and 35 56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), A5 AMENDED BY REVISING AND ADDING CERTAIN RATES AND CHARGES MAKING THIS ORDINANCE CUMU LATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE 1N CONFLICT HEREWITH, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. SECTION 1 That Section 35 56(g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows. (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers the furnishing water to such customers. (h) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater services to such customers RATE FOR WHOLESALE WASTEWATER SERVICE Volume ($/1 000 gallons) BOD ($/pound) TSS ($/pound) Customer ($/month) $ 0 8656 0.2943 0.2115 75 00 SECTION 3 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinance and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent Iunsdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, .since the same would have been enacted by the City Council without the incorporarion m this ordinance of any such unconstiturional phrase, clause, sentence, paragraph or section. This ordinance shall take effect on October 1 2004 APPROVED AS TO FORM AND LEGALITY Assistant Crty Attorney pity of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 9/28/2004 Ordinance No 16141 DATE Tuesday September 28 2004 LOG NAME 60WHOLESALE REFERENCE NO G-14519 SUBJECT Ordinance Adopting Wholesale Water Wholesale Wastewater and Raw Water Service Rates RECOMMENDATION It is recommended that the City Council adopt the attached ordinance which revises wholesale water wholesale wastewater and raw water service rates and provides an effective date of billing on or after November 1 2004 for usage of flows from and after October 1 2004 DISCUSSION Each year wholesale water and wholesale wastewater rate studies are prepared in accordance with the terms of the uniform wholesale customer contracts. For fiscal year 2005 the wholesale water cost of service study was completed by Water Department staff based on the 2002 wholesale water cost of service study performed by Camp Dresser and McKee The wholesale wastewater cost of service study was performed by Black and Veatch The result of these studies indicated the rates, as proposed below will recover the cost of providing wholesale water and wastewater service. Adjusted for street rental and system loss, the raw water charge to customers is $0 6355 inside the district and $0 6841 outside the district and is a direct "pass through to wholesale water customers.
