( '~`~ __ ~~~ AN ORDINANCE CHANGING THE NAME OF THE NEIGHBORHOOD RESOURCES DEVELOPMENT COUNCIL TO THE COMMUNITY ACTION PARTNERS COUNCIL AND CHANGING THE NAME OF THE NEIGHBORHOOD RESOURCES DEVELOPMENT PROGRAM TO THE COMMUNITY ACTION PARTNERS, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND NAMING AN EFFECTIVE DATE. WHEREAS, m 1981 the Fort Worth City Council adopted Ordinance Number 8300 establishing a fifteen member commission entitled the `Neighborhood Resources Development Council" to assist the City Council m setting priorities and involving lower income citizens in the decisions-making process for projects initiated with funding from the Community Services Administration of the United States; WHEREAS, Ordinance Number 8300 also created a division of the Human Resource Department known as the `Neighborhood Resourced Development Program administered by the Neighborhood Resourced Development Coordinator under the Director of Human Resources, to initiate studies, propose projects, develop plans for financial assistance, recommend and coordinate comprehensive programs and to perform all functions necessary to conduct programs funded by the U S. Community Services Administration, WHEREAS, City staff is recommending that the names of the Council and the Program be changed to reflect the collaborative nature of the services and the community's support of the national organization s effort to enhance the image of Community Action Agencies provided to the community and to be more consistent with the names of other Community Action Agencies; WHEREAS, the proposed name changes were unanimously endorsed by the Neighborhood Resource Development Council on August 27 2003 and the Parks and Community Services Advisory Board on October 21 2003 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That the "Neighborhood Resource Development Council" shall be renamed and hereafter called the `Community Action Partners Council" SECTION 2. That the `Neighborhood Resource Development Program shall be renamed and hereafter called the `Community Action Partners" SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordnance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall, be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same 2 would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the Code of Fort Worth which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and cnminal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but maybe prosecuted until final disposition by the courts. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. A Neighborhood Resources Development Council- is hereby estab- lished for the purpose of assisting the City Council in setting priorities and involving lower-income citizens in the decision-making process for projects initiated with funding from the Community Ser- vices Administration of the United States. SECTION 2. The initial appointments of members to even-numbered places shall be for a term of two (2) years; the initial appointments of mem- bers.to odd-numbered places shall be for a one (1) year term. There- after, each of such places shall be filled by appointment for a two (2) year term. No member selected for Places 6-15 shall serve for more than five (5) consecutive years, or more than ten (10) years altogether. SECTION 3. A division of the Human Resources Department of the City is here- by established to be known as the Neighborhood Resources Development Program. The Program shall be administered by the Neighborhood Resources Development Coordinator under the direction of the Director of Human Resources. It shall have the authority to initiate studies, propose projects,- develop plans for financial assistance, recommend -and coordinate comprehensive programs and perform all functions neces- sary to conduct programs funded by the U. S. Community Services Admin- istration; it shall have the cooperation of all departments of .the City in the performance of these duties. ~% v. .'a - SECTION 4. A Neighborhood Resources Development Coordinator shall be appointed by the City Manager, and such officer or his authorized representative shall serve as the. non-voting Secretary of the Neighborhood Resources Development Council. It shall be the duty of ~ the Secretary to prepare and be custodian of all necessary minutes and ~! records. SECTION 5. The Neighborhood Resources Development Council shall review the various proposed U. S. Community Services Administration projects and plans for community action programs and make recommendations to the City Council. with regard to such projects and plans which assist the City Council in setting priorities and involve lower-income citizens in the decision-making process. SECTION 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, para- graph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdic- tion, such unconstitutionality shall not affect any of the remaining phrases, clauses,- sentences, paragraphs and sections of this ordi- nance, since the same would have been enacted by the,- City Council without the incorporation in this ordinance of any such unconstitu- tional phrase, clause, sentence, paragraph or section. SECTION 7. This ordinance shall be in full force and effect from and after the date of its passage, and it is so ordained. Tuesday January 27 2004 LOG NAME. 80NAMECHANGE SUBJECT Adoption of Ordinance Changing the Name to Community Action Partners Council and Program to Community Action Partners RECOMMENDATION REFERENCE NO *G-14238 of the Neighborhood Resources Development Council the Name of the Neighborhood Resouces Development It is recommended that the City Council adopt the attached ordinance approving the recommendation of the Neighborhood Resources Development Council and the Parks and Community Services Advisory Board to change the name of the Neighborhood Resources Development Council to Community Action Partners Council and the Warne of the Neighborhood Resources Development Program to Community Action Partners DISCUSSION In 1981 Ordinance No 8300 established the Neighborhood Resources Development Council (NRDC) and the Neighborhood Resources Development Program (NRDP) which serves as the Community Action Agency for Tarrant County Currently socia{ services such as food shelter utilities clothing transportation, childcare and holiday assistance programs are provided to low-income individuals and families from nine NRDP locations throughout Fort Worth and Tarrant County This name change will enhance communication and customer service in the following ways. a) The name is more representative of the collaborative nature of the services provided to the community and b) It is more consistent with the names of other Community Action Agencies (CAA) throughout Texas and c) The name reflects the community's support for the national organization's effort to enhance the image of the CAAs. The name change was unanimously endorsed by the NRDC on August 27 2003 the Park and Community Services Advisory Board on October 21 2003 and the Government and Neighborhood Relations Committee on December 2 2003 This program serves ALL COUNCIL DISTRICTS FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds. ,..,.,.,,o.
