HomeMy WebLinkAboutOrdinance 16043Ordinance No ~O~ ~`3 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENT DISTRICT FUND IN THE AMOUNT OF $293,738 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING IMPROVEMENTS AND SERVICES IN PUBLIC IMPROVEMENT DISTRICT NO 1 (DOWNTOWN); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-2004 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Special Assessment District Fund in the amount of $293,738 from available funds for the purpose of funding improvements and services in Public Improvement District No. 1 (Downtown): SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 15636 and all other ordinances and appropriations amending the same except in those instances. where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting .provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. The advisability of re-establishing and enlarging the proposed district; b The general nature of the proposed improvements and/or services c. The estimated costs thereof• d. The boundaries of the proposed district; e The proposed method of assessment; and f The proposed apportionment of costs between the improvement district and the City as a whole and 2. Adjourn such public hearing and 3 Adopt the attached resolution which a. Re-establishes a Public Improvement District under Chapter 372, Local Government Code (the Act") to be known as the Fort Worth Public Improvement District No 1 (Downtown) b Authorizes the City to exercise the powers granted by the Act in connection with the re- establishment of the Public Improvement District; c. Makes findings concerning the nature and advisability of the improvements and/or services to be provided by the district, the estimated costs the boundaries of the district, the method of assessment and the apportionment of costs between the district and the City as a whole d Direct the City Secretary to publish notice of the re-establishment of the district as required by the Logname: 13PID 1 PUBHEAR04 Page 1 of 3 Act; and 4 Approve the attached service plan and budget for FY 2004-05 as recommended by the Advisory Board of PlD No 1 and 5 Authorize the transfer of $293 738 from the General Fund to the Special Assessment District Fund PID No 1 FY 2004-2005 project account; and 6 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $293 738 in the Special Assessment District Fund from available funds and 7 Authorize the transfer of $26 600 for administrative fees from the. Special Assessment District Fund PID No 1 FY 2004-05 project account to the General Fund and 8 Authorize the City Manager to contract with Downtown Fort Worth Inc. to provide improvements and services in PID No 1 during FY 2004-05 for the sum of $1,330 000• and 9 Adopt the proposed 2004 assessment roll which is on file with the City Secretary and set Tuesday September 7 2004 at 7 00 p m. in the City Council Chambers as the. time and place for the benefit hearing• and 10 Direct the City Secretary to give notice of the September 7 2004 hearing in accordance with state law• and 11 Approve adding to the 2004-2005 budget, as contingency any unencumbered revenues from PID No 1 assessments from prior years. DISCUSSION On June 8 2004 the City Council received a petition requesting re-establishment and enlargement of PID No 1 The petition established an advisory body to develop and recommend a service improvement and assessment plan The Council approved M&C G-14405 at its regular and public meeting on June 29 2004 which found that the petition was sufficient, met the requirements of Chapter 372 of the Act and the City PID policy and authorized the proceedings to re-establish PID No 1 The approved M&C G-14405 further set a public hearing on July 20 2004 at 10.00 a.m concerning various matters regarding the re-establishment of PID No 1 The City Secretary gave notice of the hearing. as prescribed by the Act.
