DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE PURPOSE OF FUNDING AN AMENDMENT TO A CONSULTANT AGREEMENT WITH STANLEY LOVE-STANLEY P C FOR PHASE II OF AN ARCHITECTURAL DESIGN AND CONSTRUCTION SERVICES RELATED TO THE EVANS AND ROSEDALE BUSINESS AND CULTURAL DISTRICT PROJECT MAKING THI5 ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-2004 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $749 000 subject to receipt of the Section 108 loan from the U S Department of the Housing and Urban Development, for the purpose of funding an amendment to a Consultant Agreement with Stanley Love-Stanley P C for Phase II of an Architectural Design and Construction Services related to the Evans and Rosedale Business and Cultural District Project. SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shalt be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 15636 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY Assistant Ci y Attorney ADOPTED AND EFFECTIVE. ~`~ -~~ City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 9/28/2004 Ordinance No. 16146 CONTINUED FROM A PREVIOUS WEEK DATE Tuesday September 21 2004 LOG NAME. 20SLS REFERENCE NO C-20294 SUBJECT Adopt Appropriation Ordinance and Authorize Phase II of the Consultant Agreement for the Evans and Rosedale Business and Cultural District Redevelopment Project RECOMMENDATION It is recommended that the City Council authorize the City Manager to 1 Issue a $749 000 amendment to the consultant agreement with Stanley Love-Stanley P C (SLS) for architectural design and construction phase services related to the Evans and Rosedale Business and Cultural District project; and 2. Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Grants Fund by $749 000 DISCUSSION On June 15 2004 (M&C C-20114) City Council authorized the expenditure of $300 000 on consultant fees for market analysis, master site planning and preliminary facility programming for the Evans and Rosedale Business and Cultural District project. Additionally the Mi3~C reported that a fee of $704 500 had been negotiated with SLS the prime consultant for the project, for phase II of the consultant's services. Phase II is for architectural design and construction phase services fora $7 000 000/43 000 square foot Public Health Building/Branch Library complex on the 15 acre Evans and Rosedale Business and Cultural district site. After the fee of $704 500 was negotiated it was determined that, to optimize the master plan product, the consultant would need to conduct a more detailed assessment of the community surrounding the Evans and Rosedale area than originally thought. The additional fee associated with these services is $30 000 Additionally it was discovered that the existing topographic and boundary surveys for the 15 acre site were inadequate. The fee to provide the quality of survey needed is $14 500 The total phase 11 consultant fees then will be $749 000 The additional fees associated with the expanded master plan and survey can be accommodated from the contingency amount established in the original project budget. No need for additional funding is anticipated as a result of these increases in consultant fees Funds for this phase wil{ come from the Section 108 funds designated for this project. The Section 108 Loan Application has been amended and final approval is pending with HUD Washington HUD Washington has given written approval to the City to proceed with apre-award of the Section 108 and expenses incurred will be eligible for reimbursement from the Section 108 funds once they are received HUD regulations allow for funds to be made available through apre-award process which City staff has followed. SLS is in compliance with the City's MWBE ordinance by committing to 30% MWBE participation on the Lo~name 20SLS Paaa ~ ~f~ Phase II consultant services.
