AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $131,546.00 AND IN
THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $289,196.30. FOR
PAVEMENT RECONSTRUCTION, WATER AND SANITARY SEWER MAIN
REPLACEMENTS, GROUP A, PROJECT NUMBER 00923}; PROVIDING FGR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
GRDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BYTHE CITY COUNCIL OFTHE CITYOF FORTWORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and
in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in
the Water Capital Projects Fund in the amount of $131,546.00 and in the Sewer Capital Projects Fund in
the amount of $289,196.30 from available funds, for pavement reconstruction, water and sanitary sewer
main replacements, Group A, Project Number 00923}.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3,
That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4,
This ordinance shall take effect upon adoption.

Authorize the Execution of a Contract in the Amount of $2,285,525.54 with Stabile and Winn, Inc., for
Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Portions of Boston
Avenue, Chelsea Road, Chicago Avenue, Clairemont Avenue, Junius Street, Lynnhaven Road and Norma
Street and Adopt Appropriation Ordinance
RECOMMENDATIQN;
It is recommended that the City Council:
1. Authorize the transfer of $1,626,142.36 from the Water and Sewer Gperating Fund to the Water Capital
Projects Fund in the amount of $131,546.66 and Sewer Capital Projects Fund in the amount of
$289,196.36;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $131,546.66 and the Sewer Capital Projects Fund in the
amount of $289,196.30 from available funds; and
3. Authorize the City Manager to execute a contract with Stabile and Winn, Inc., in the amount of
$2,285,525,54 for pavement reconstruction, water and sanitary sewer main replacement for streets listed
below.
DISCUSSION:
On December 11, 2001, ~M&C C-22569} the City Council authorized the City Manager to execute an
Engineering Agreement with Teague Nall and Perkins, Inc., for the redesign of the streets listed below.
Pavement reconstruction, water and sewer main line replacements are within the scope of design and
reconstruction.
The 2061 Critical Capital Projects Fund includes funds for pavement reconstruction for the streets listed in
Group A.
The Water Department has determined that that deteriorated water and sewer lines should be replaced
prior to street reconstruction.

This Contract was advertised on July 2, 2009, and July 9, 2009, in the Fort Worth Star-Tele~rarn. On
August 13, 2009, the following bids were received:

The new pavement will consist of eight inches of concrete over six inches of lime stabilized sub grade with
a seven inch curb. The alternate bid will allow the construction of sidewalks.
Funding in the amount of $65,744.00 is included for associated water and sewer construction surveying,
project management, material testing, field inspection and project close out water $47,349.00; and sewer
$18,395.00}. The contingency funds to cover change orders total $37,895.30 water $25,000.00; and
sewer $12, 895.30 }.
Funding in the amount of $128,067.00 is included for associated Transportation and Public Works
Department ~TPW}construction surveying, project management, material testing, field inspection and
project close out. The contingency funds to cover change orders is $40,873.00.
MIWBE -Stabile and Winn, Inc., is in compliance with the City's MIWBE Ordinance by committing to four
percent MIWBE participation and documenting good faith effort on this combined project. Stabile and
Winn, Inc., identified several sub contracting opportunities; however, the MIINBE subcontractors contacted
in the areas identified did not respond or did not submit the lowest bids. The City's MIINBE goal on this
combined project is 27 percent.
Staff recommends that the base bid plus the alternate option submitted by Stabile and Winn, Inc., be
selected and a contract be awarded to Stabile and Winn, Inc.
This project is located in COUNCIL DISTRICT 8, Mapsco 78D, 78H, 78G, 79A, 796 and 79EIF.
FISCAL INFORMATION I CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the recommendations and
adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as
appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the 2007 Critical
Capital Projects Fund.
