I ~ `-i'~~ AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH, AMENDING SECTION 6.506 TO REQUIRE LANDSCAPING TO BE SHOWN ON UNIFIED RESIDENTIAL DEVELOPMENT SITE PLANS; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in response to requests from the Commercial Corridors Task Force, the City Plan Commission, and City Council members, the City Manager appointed a Development Standards Task Force to conduct a review of development standards and procedures as they affect central city revitalization and other City Council strategic goals; WHEREAS, the Development. Standards Task Force is comprised ~of 42 members, consisting of public officials, representatives from the development community, and neighborhood and business leaders; WHEREAS, the Development Standards Task Force formed four committees to focus on four categories of development issues: construction codes, subdivision and street development standards, zoning regulations, and process improvements; WHEREAS, after studying the zoning ordinance and conducting numerous meetings and public forums the zoning subcommittee of the Development Standards Task Force has recommended amendments to the zoning ordinance; WHEREAS, the proposed amendments reduce and simplify off-street parking requirements; allow townhouses, zero lot line residential dwellings, and cluster housing to be constructed in the "C" and "D" multifamily districts at the same density as apartments; update site plan standards; allow private parks and private recreation facilities in all single-family districts; delete obsolete industrial uses from the Nonresidential District Use Table; allow trees planted in the parkway to be credited toward landscape requirements; establish development standards for single- family detached dwelling units on 3,300 square foot lots in the "Rl" Zero Lot Line/Cluster district; and repeal maximum lot coverage regulations for "A-2.5" through "A-5" One-Family and "B" Two-Family Districts so that lot coverage will be limited only by setback requirements; WHEREAS, in order to simplify consideration of the proposed amendments, each issue has been included in a separate ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF FORT WORTH, TEXAS: SECTION 1. Section 6.506, "Unified Residential Development", Subsection F, "General Site Plan Requirements", is renamed and amended to read as follows: F. General Site Plan Requirements 4. Landscape and Walkways: Show landscape materials, required and proposed height of perimeter walls, bufferyards, and recreational facilities. Walkways shall be provided to connect to all buildings, parking areas and recreational facilities and shall be shown on the site plan. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. 2 SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 5. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official 3 newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. SECTION 7. This ordinance shall take effect upon adoption and publication as required by law.
