I ~t.J7" AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH„ AMENDING SECTION 4.603 TO ALLOW PRIVATE PARKS AND NEIGHBORHOOD RECREATION CENTERS IN ALL RESIDENTIAL DISTRICTS, AMENDING SECTION 9.01 TO ADD A DEFINITION OF NEIGHBORHOOD RECREATION CENTER"• PROVIDING THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in response to requests from the Commercial Corndors Task Force, the City Plan Commission, and Crty Council members, the Crty Manager appointed a Development Standards Task Force to conduct a review of development standards and procedures as they affect central city revrtahzation and other Crty Council strategic goals, WHEREAS, the Development Standazds Task Force is comprised of 42 members, consisting of public officials, representatives from the development commumty and neighborhood and business leaders, WHEREAS, the Development Standazds Task Force formed four comrmttees to focus on four categories of development issues: construction codes, subdivision and street development standards, zomng regulations, and process nnprovements; WHEREAS, after studying the zoning ordinance and conducting numerous meetings and public forums the zoning subcomrmttee of the Development Standazds Task Force has recommended amendments to the zomng ordinance; WHEREAS, the proposed amendments reduce and sunphfy off-street pazlcmg requirements; allow townhouses, zero lot tine residential dwellings, and cluster housing to be constructed m the `C" and `D" multifamily districts at the same density as apartments, update site plan standazds; allow private pazks and pnvate recreation facilities m all single-family districts; delete obsolete industrial uses from the Nonresidential District Use Table; allow trees planted in the pazkway to be credited toward landscape requirements; establish development standazds for single- family detached dwelling amts on 3,300 squaze foot lots in the `R1 Zero Lot Line/Cluster district; and repeal maximum lot coverage regulations for A 2.5" through A 5" One-Family and `B" Two-Family Districts so that lot coverage will be lirriited only by setback requirements, WHEREAS, in order to simplify consideration of the proposed amendments, each issue has been included m a separate ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Section 4.603 `Residential District Use Table `Recreation is amended to allow private parks and neighborhood recreation centers as permitted uses in all residential districts, by inserting `Neighborhood recreation center" before `Park or playground (public)" inserting `Pazk (private ') after `Pazk or playground (public)" and inserting a `P"mall columns from A 2.5" through `MU 2" and a diamond in the `PD" column for both uses. SECTION 2. Section 9 101 `Defined Terms" is amended to add a definition of `neighborhood recreation center" as follows NEIGHBORHOOD RECREATION CENTER. A privately established and operated facility located m a residential subdivision that provides recreational opportunities for. residents of the subdivision and their guests. 2 SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Crty Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 6. All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both 3 civil and' crunmal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 7 The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days m the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code. SECTION 8.
