BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT all of Avenue A, being 825-foot long and 52 foot wide 1}nng between Wesleyan Street and South Collard Street in the J Ringer Survey Abstract No 1287 and the W J Sublett Survey Abstract No 1409 of the City of Fort Worth, Tarrant County Texas, and containing 44,956 square feet, more or less, per Exhibit A and as more specifically described in the above-named Exhibit attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law SECTION 3 That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense SECTION 4 That all ordinances or parts of ordinances m conflict herewith are hereby repealed. Tuesday July 27 2004 LOG NAME, 06VA-04-006 REFERENCE NO PZ 2538 SUBJECT VA-04-006 Street and Alley Vacation~lAdoption of Ordinance Vacating all of Avenue A between Wesleyan Street and South Collard Street and Waiver of Fee RECOMMENDATION It is recommended that the City Council: 1) Adopt the attached ordinance vacating all of Avenue A between Wesleyan Street and South Collard Street being approximately 825 feet long and 52 feet wide and containing 44 956 square feet; and 2) Authorize the waiver of collection of $11,239 for the value of the vacated right-of-way DISCUSSION Adoption of the attached ordinance would vacate all of Avenue A from its intersection with the easterly right- of-way line of Wesleyan Street to its intersection with the westerly right-of-way line of South Collard Street, containing 44 956 square feet of land. Brockette Drake and Davis, acting on behalf of Steve Roberts for Texas Wesleyan University have requested to vacate the above referenced street in order to proceed with plans to build new on-campus student housing and to incorporate said street in the development plan as an emergency access, utility and drainage easement. The Engineering Department, Real Property Services Division has determined that the value of the vacated right-of-way is $11,239 In accordance with the city's 'Policy Regarding Valuation of Street Vacation Transactions in Central City Redevelopment Neighborhoods" (M&C G-12532 April 6 1999) the City Council may waive the collection of the fees for vacated right-of-ways. The applicant has requested that the City Council waive said fee Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on April 28th 2004 An acceptable replat has been received This request is located in COUNCIL DISTRICT 5 FISCAL.
