HomeMy WebLinkAboutOrdinance 15850ZC-03-286G L`' - ORDINANCE NO AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, AMENDING SECTION 6.301 TO ALLOW TREES IN THE PARKWAY TO BE CREDITED TOWARD REQUIRED LANDSCAPE AREAS, PROVIDING THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, m response to requests from the Commercial Corridors Task Force, the City Plan Commission, and City Council members, the City Manager appointed a Development Standards Task Force to conduct a review of development standards and procedures as they affect central city revitahzahon and other Crty Council strategic goals, WHEREAS, the Development Standards Task Force is compnsed of 42 members, consisting of public officials, representatives from the development community and neighborhood and business leaders; WHEREAS, the Development Standards Task Force formed four committees to focus on four categones of development issues: construction codes, subdivision and street development standards, zoning regulations, and process unprovements, WHEREAS, after stud}nng the zoning ordinance and conducting numerous meetings and public forums the zoning subcomrnittee of the Development Standards Task Force has recommended amendments to the zoning ordinance; WHEREAS, the proposed amendments reduce and simplify off-street parking requirements; allow townhouses, zero lot line residential dwellings, and cluster housing to be constructed m the `C" and `D" multifamily distncts at the same density as apartments; update site plan standards; allow pravate parks and pnvate recreation facilities m all single-family districts, delete obsolete industrial uses from the Nonresidential Distract Use Table; allow trees planted in the parkway to be credited toward landscape requirements, establish development standards for single- family detached dwelling amts on 3,300 square foot lots in the `R1 Zero Lot Line/Cluster distract; and repeal maxunum lot coverage regulations for A 2.5" through A 5" One-Family and `B" Two-Family Distracts so that lot coverage will be lunited only by setback requirements, WHEREAS, in order to simplify consideration of the proposed amendments, each issue has been included m a separate ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Section 6.301 `Landscaping Subsection H, `Landscape Area Required" is amended to add the following subsection 3 and to renumber `Minimum Landscape Area for Undeveloped Sites" as subsection 4 H. Landscape Area Required 3 Landscaping in Parkway Parkway (area between the street curb and front property line) may be counted toward landscape area required by this subsection. Trees may be planted in this area and used to meet tree requirements in Sections 6.301.H.1.a or 6.301.H.2.a, subject to approval by the Parks and Community Services and Transportation and Public Works Departments. Groundcover and flowers are permitted in the parkway Shrubs are prohibited. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in 2 direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code aze hereby repealed. SECTION 3. It is hereby declazed to be the intention of the City Council that the sections, pazagraphs, sentences, clauses and phrases of this ordinance aze severable, and, if any phrase, clause, sentence, pazagraph or section of this ordinance shall be declazed unconstitutional by the valid judgment or decree of any court of competent ~unsdichon, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a sepazate offense. SECTION 5. All nghts and remedies of the City of Fort Worth, Texas, aze expressly saved as to any and all violations of the provisions of Ordinance No 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and crunmal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. 3 SECTION 6. The Crty Secretary of the Crty of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code.
