AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, AMENDING SECTION 4.301 TO DELETE REQUIREMENT THAT PLANNED DEVELOPMENT SITE PLANS SHOW LAND AREA OF ADJACENT SITES, PROVIDING THAT THIS ORDINANCE IS CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, m response to requests from the Commercial Corndors Task Force, the Crty Plan Commission, and Crty Council members, the Crty Manager appointed a Development Standards Task Force to conduct a review of development standards and procedures as they affect central city revitalization and other Crty Council strategic goals, WHEREAS, the Development Standards Task Force is compnsed of 42 members, consisting of public officials, representatives from the development community and neighborhood and business leaders; WHEREAS, the Development Standards Task Force formed four comrmttees to focus on four categones of development issues: construction codes, subdivision and street development standards, zomng regulations, and process unprovements; WHEREAS, after studying the zoning ordinance and conducting numerous meetings and public forums the zoning subcomrmttee of the Development Standards Task Force has recommended amendments to the zomng ordinance; WHEREAS, the proposed amendments reduce and sunphfy off-street parking requirements; allow townhouses, zero lot line residential dwellings, and cluster housing to be constructed m the `C" and `D" multifamily distracts at the same density as apartments; update site plan standards, allow pravate parks and pnvate recreation facihhes m all single-family distracts, delete obsolete industrial uses from the Nonresidential Distract Use Table; allow trees planted m the parkway to be credited toward landscape requirements; establish development standards for single- family detached dwelling amts on 3,300 square foot lots in the `Rl Zero Lot Lme/Cluster chstnct; and repeal maximum lot coverage regulations for A 2.5" through A 5" One Family and `B" Two-Family Distracts so that lot coverage will be lumted only by setback requirements, WHEREAS, in order to simplify consideration of the proposed amendments, each issue has been included m a separate ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Section 4.301 `Designation of `PD Distract" Subsection B, `Site Plan Requirements" is amended to delete the requirement that land area of adjacent sites be shown on Planned Development site plans, as follows. B. Site Plan Requirements 1 The land area included within -the site, the zoning classification of adjacent sites, and all public and pnvate rights-of way and easements bounding and intersecting the site and the adjacent sites which are proposed to be continued, created, relocated and/or abandoned. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. 2 SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordnance are severable, and, of any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordnance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists. the enforcement of any of the provisions of thus ordnance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 5. All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and cnminal, whether pendng m court or not, under such ordnances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the captnon, penalty clause and effective date of this ordinance for two (2) days m the officnal 3 newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code.
