HomeMy WebLinkAboutOrdinance 18931-12-2009Qrdinance No. 15931-12-2009 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANT CAPITAL PROJECTS FUND !N THE AMOUNT 4F $415,435.00 UPQN RECEIPT QF FUNDS FROM FEDERAL CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM FUNDS AND THE CAMP BOWIE DISTRICT, INC., FOR RIDGLEA VILLAGE PEDESTRIAN AND STREETSCAPE IMPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE CF PR14R ORDINANCES AND REPEALING ALL PR14R ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY C4UNClL 4F THE CITY CF FORT UVQRTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grant Capital Projects Fund in the amount of $415,435.00, upon receipt of funds from federal Congestion Mitigation and Air Quality Improvement Program funds and the Camp Bowie District, Inc., for Ridglea Village pedestrian and streetscape improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.1SS09 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to execute a Local Transportation Project Advance Funding Agreement (LPAFA) with the Texas Department of Transportation for federal Congestion Mitigation and Air Quality Improvement Program (CMAQ) funds in the amount of $380,349.00; 2. Authorize the City Manager to accept federal CMAQ funds from the Texas Department of Transportation, awarded through the North Central Texas Council of Governments' 2001 Land UselTransportationDoint Venture Funds Program, in the amount of $380,349.00 for a pedestrian improvement project in the Ridglea Urban Village; 3. Accept a pledge by Camp Bowie District, Inc., to provide a 20 percent local match requirement consisting of $83,677.00 cash and $11,410.00 in in-kind contributions; 4. Authorize the recording in the Grant Capital Projects Fund of $11,410.00 in Inkind Revenue and Expenditures representing the contribution to the Texas Department of Transportation made by Camp Bowie, Inc., in 2006; and 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Capital Projects Fund in the amount of $475,436.00 from the federal CMAQ funds and the Camp Bowie District, Inc., contribution. DISCUSSIGN: The Land Use/Transportation Joint Venture Program is an initiative of the (NCTCG) Regional Transportation Council (RTC) to improve regional air quality and promote sustainable development. The program provides funding for transportation projects that support private mixed-use development within a pedestrian and/or transit oriented environment. The Joint Venture Program is a precursor to the 2005 and 2009 Sustainable Development programs. 0n October 11, 2001, the RTC selected the Ridglea Urban Village Project for funding in the amount of $380,349,00 in federal CMAQ funds through the Land UselTransportation Joint Venture Program. 0n June 17, 2003, ~M&C G-13994} the City Council authorized the City Manager to execute a LPAFA with TxDOT, but at that time funding was not accepted or appropriated via Council action. The City must enter Logname: 4bRIDGLEA JOINT VENTURE PR~f ECT Page 1 of 2 into a new LPAFA with TxDOT to correct an error in the previously accepted LPAFA. The error added the direct state costs to the total project budget estimate rather than subtracting that amount from the project budget subtotal. Therefore the corrected budget will reflect the federal grant awarded amount of $380,349.00 instead of the incorrect amount of $422,187.00. Camp Bowie District, Inc., has pledged to provide a cash contribution of $95,081.00 as the 20 percent local match for this project, of which the District has already paid $11,410.00 to TxDQT after entering into the LPAFA currently in effect. Camp Bowie District, Inc.'s remaining financial responsibility is $83,617.00 to fulfill the required match. Following the appropriation of funds, City staff will distribute a Request for Qualifications ~RFQ} to architectural and engineering firms to design enhanced crosswalks at the intersection of Camp Bowie Boulevard and Westridge Avenue. Any remaining funding will be used to provide additional streetscape improvements, including but not limited to: street trees, pedestrian lights, benches, trash bins, bike racks and wayfinding signs. Following selection of a preferred consultant and contract negotiations, staff will seek Council authorization to execute a design contract. The preliminary project schedule anticipates the commencement of design work by the beginning of 2010 and completion of construction by the fourth quarter of 2011. This project is located in CQUNCIL DISTRICT 3.
