AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT FUND IN THE
AMOUNT OF $57,900.00 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
FUNDING AMENDMENT NO 1 TO CITY SECRETARY CONTRACT 27304 WITH
HERITAGE ENVIRONMENTAL SERVICES, INC FOR THE TRANSPORTATION
AND DISPOSAL OF HOUSEHOLD HAZARDOUS WASTE AT THE
ENVIRONMENTAL COLLECTION CENTER; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS•
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-
2004 in the Budget of the City Manager there shall also be increased estimated receipts and
appropriations in the Environmental Management Fund in the amount of $57,900 00 from available
funds for the purpose of funding Amendment No 1 to City Secretary Contract 27304 with Heritage
Environmental Services, Inc. for the transportation and disposal of household hazardous waste at
the Environmental Collection Center
SECTION 2
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction such decision opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 15636 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

Approval of Supplemental Appropriation Ordinance and Authorization to Amend the Contract with
Heritage Environmental Services Inc. for the Transportation and Disposal of Household Hazardous
Waste for the Environmental Collection Center
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached supplemental appropriation ordinance increasing appropriations and estimated
receipts by $57 900 from available funds in the Environmental Management Operating Fund and
2. Authorize the City Manager to execute Amendment No 1 to City Secretary Contract No 27304 with
Heritage Environmental Services, Inc for the transportation and disposal of household hazardous waste at
the Environmental Collection Center for an additional $57 900 thereby increasing the total contract amount
to $362 900 for the contract period January 1 2003 through December 31 2003 and for the renewal
option terms for 2004 and 2005
DISCUSSION
On October 2 2001 (M&C C-18763) the City Council awarded a $305 000 contract to Heritage
Environmental Services Inc. for the transport and disposal of household hazardous waste collected at the
Environmental Collection Center (ECC) The estimated not-to-exceed amount was based on the increase
in estimated service numbers and an approximation of waste volumes based on previous years
performance The participation/utilization rate at the ECC which provides Fort Worth and surrounding area
citizens a convenient. place to dispose of household hazardous waste has greatly increased within the last
several years In 2002 the ECC accepted household hazardous waste from 15 629 participants and in
2003 from 17 076 participants With the increase in participation the ECC also realized an increase in the
volume of waste collected at the facility Uncharacteristic to previous years, the last quarter of calendar
year 2003 resulted in a 19% increase in usage over previous years and the acceptance of significantly more
waste than anticipated For the calendar year 2003 the ECC was $57 900 over estimates for waste
disposal as a result of the center's popularity
Amending the existing contract from $305 000 to $362 900 will cover outstanding invoices from January to
December 2003 Additionally the renewal amounts for this contract will be raised to $362 900 annually to
cover the anticipated cost increase for 2004 and the remaining annual renewal option in 2005 The cost of
these services will be paid from revenues generated by the Environmental Protection Fee and fees charged
to participating cities for use of the facility and .its services
M/WBE A waiver of the goal for MNVBE subcontracting requirements was requested by the department
and approved by the M/WBE Office because the contract requirements and the purchase of services is from
sources where subcontracting or supplier opportunities are negligible
